PROCEEDINGS TO ACQUIRE CERTAIN REAL PROPERTY NEEDED
TO ACQUIRE AND CONST"ttUCT PUBLIC IMPROVEMENTS IN CONNECTION WITH ~
BLANEI' AVENUE, ET AL. STREET WIDENING PROJECT
ASSESSMENT DISTRICT AD 70-1
RESOLVED, by the City Council of the City of Cupertino,
California, that
WHEREAS, on June 21, 1971, this Council adopted a
resolution and order adopting the engineer's report, con~irming
the assessment and ordering the work and acquisitions in con-
nection with the above assessment dis~rict;
TrlsiF,REAS, in order to construct the necessary public
improvements it will be necessary to acquire parts o~ certain ~
parcels of real property within said district;
' wHEREAS, many of the property owners in t'~e assess-
ment district have ten'ta'tively agreed with the sta~~ o~ ~he City
. to dedicate the necessary parts of their respective parcels a~
real property, in return for either cash or credit against thei~
. respective assessments in the am~unt of the fair market val~,e
thereof;
~ WHEREAS, in order for the work to ~roceed, it will
be necessary to complete said dedications not la~er than ~uly o,
1971; and, ~ , , .
wHEREAS, in the event said dedications are not com-
pleted on or before said date, it will be necessary for the
City to institute eminent do:nain proceedings ar_d to acr~uir.e orders
of immediate possession of said parts of parcels of real prop-
erty;
NOW, Ti~R~FOR, IT IS ORDERED as follows:
l. That this Council hereby expresses its intent
. . to adopt an appropriate resolution on July 6, 1971, to comm~nce
eminent domain proceedinqs to acquire the necessary parts of ~
those certain parcels of real property required to construct
the public improvements provided by said special assessment .
project which have not by then been dedicated to the City.
~ 2. ~In order to avoid the additional cxpense which
will be entailed by comm~ncing legal proceedings, the own~rs
of those parts of the parcels of real property which ~aill be
required by the City for the construction of said public im-
provements are requested to cooperate with the staff of the City
in taking the necessary steps to complete the dedications which
will be required for said project, upon such terms as may be
mutually agreed upon.
PASSED AND ADOPTED at a regular meeting of the City
Council of the City of Cupertino this 21st day of June, 1971,
by the following vote:
