CC Resolution No. 3000-10 WJML:KJmh ~-30-71-15 RESOLUTION N0. 3000-10 A RESOLUTION CALLING FOR SEALED PROPOSALS AND FIXING LIQUIDATED DAMACES FOR FAILURE TO COMPLETE THE WORK WITHIN TiME SPECIFIED BLANEY AVENUE, ET AL. STREET WIDENING PROJECT ASSESSMENT DISTRICT AD 70-1 RESOLVED, by the City Council of the City of Cupertino, California, that WHEREAS, on December 21, 1970, said Council adopted its . Resolution of Intention No. 3000, to order the construction of pavement, curbs, gutters, sidewalks, street lighting ~ facilities, storm drainage facilities as required, and a.ll necessary auxiliary work in Blaney Avenue, Price Avenue, Forest Avenue and Portal Avenue in said City, all as more particularly described'and set~f'orth in said Resolution of ~ Intention; NOW, THEREFORE, the City Clerk of this City is hereby directed to publish once a week for two weeks in the Cupertino Courier, a newspaper published and circulated in said City, a notice inviting sealed proposals or bids f or the construction of said improvements, and i•eferring to the plans and specifications on file in the office of said City Clerk, the first publication of which notice shall be at least fourteen days prior to the time fixed for opEning bids. , All proposals or bi~ds shall be accompanied by cash, a • cashier's or certified check payable to the order of the City Clerk, amounting to 10~ of the bid, or by a bor~d ir said amount and payable to said Clerk signed by the bidder and a corporate surety or by the bidder and two sureties who shall ~justify before any officer competent to administer an oath, in double said amount and over and above all statutory exemp- tions. The amount so posted shall be forfeiied to said Gity in case the bidd~er depositing the same does riot, within fif- teen days after written natice that the contract has been awarded to him, enter into a contract with the c;ity. It is hereby determined that in the event the contractur, contracting owners included, does not complete the work with- in the time limit specified in the proposed contract, or within such further time as thls Counci~ shall have authorized, the contractor or contracting awners, as the case may be, shall pay to the City liquidated damages in the am~unt of Fifty ~ - dolla~rs 50.00 ~ per day far each and every day's delay in finishing the work beyond the completi~n date specified in said contract. Additional provisions with regard to said. time of completion and liquidated damages are set forth in the specifications, which provisions are hereby re- ferred to and. incorporated herein by reference. Said sealed proposals or bids shall be delivered to the City Clerk of this City on or before 2:00 o'clock P.M. , on the 14th day of June, 1971, said time being not less than fourteen days from the time of the first publication of said. notice. Bids will be publicly opened, examined and declared on said day and hour and referred-_4r,,9 d considered by the City Council at its meeting at 8�=00 o'c ock P.M. on June 21, 1971.
