BEZNG A RESOLUTION OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF E.ASEMENT
WH~REAS, the STONESON DEVELOPMENT CORPORATION, grantor, has
executed a Grant of Easement which is in good and sufficient form,
conveying to the CITY OF CUPERTINO, grantee9 an easement for roadway
purposes over the property situate in ~the City of Cupertino, County.
of Santa Clara, State of California, described as followse
BEGINNING at the westerly termirius of the course described
as "North 89° ~1' S5"West, 169e68 feet" in PARCEL 1 of the
Deed from the Stoneson Developmer~t Corpor.ation to the State
of Calif'ornia recorded October 169 1gb49 in Book 670~+ of
Official Records, at Page 688, Santa C1ara County Records;
thence leaving said POINT OF BEGINNTNG and ru.nning along the
boundar.y lin~s of said lands conveyed ~~o the State of Cali-
fornia, along the arc of a cur°ve to the right from a~tangent
which bears North 8g~ 11' S5" West hasring a radius of ~25 feet
through a central angle of 83° 31' 05" for ax~ arc length of
619.52 feet ~to a point of reverse curavature; thence along the
arc of a curve to the left having a radius of 2,128 feet through

Grantor hereby further grants to Grantee the right and privilege
to enter upon his lands contiguous to and along the line of said here-
inabove described strip for the purpose of locatin.g, cons~tructing,

repairing, maintaining, or replacing public utilities or appurtenances
thereto, and for the purpose of doing any necessary or lawful ac~t in
cor~nection with the construction or mairatenance of said public utili-
ties; there is also granted thF right of ~he use of sufficien~t land
contiguous to said strip on either or. both sides thereof for the pur-
poses of excavation of and deposit of earth and necessary building
material during t~e time of constructing said public u~tilities, and
any repai.r thereof e
The foregoing is subject to the fo~lowing express conditions:
The Grantee agrees to restore the ground surface ar~d any improve-
ments thereon to its original grade or conditi.on insof ar as it is
practicable and reasonable to do soo
NOW9 THEREFORE9 IT IS HEREBY RESOLVED, th~t the City of Cupertino
accept said Grant of Easement so tendered9 and
IT IS FURTHER RESOLVED, that the Ci~ty Clerk be and he is hereby
