ORDINANCE N0. 936
AN ORDTNANCE OF THE CITY COUNCIL OF THE CITY
OF CUPERTINO PINDING AI4D DECLARING THAT CERTAIN
PRIVATELY-OWNED AND MAINTAINED PARKING FACILITIES
ARE GENERALLY HELD OPEN FOR USE OF THE PUBLIC
FOR PURPOSES OF VEHICULAR PARKING, AND ADDING
SECTION 11.28.070 TO THE CUPERTINO MUNICIPAL
CODE, TO PROVIDE A MEANS FOR THE ENFORCEMENT OF
PARKING REGULATIONS IN PRIVATE PARKING AREAS
PURSUANT TO SECTION 21107.8 OF THE CALIFORNIA
VEHICLE CODE, AND DECLARING THE URGENCY THEREOF.
HE IT ORDAINED BY THE COUNCIL OF THE CITY OF CUPERTINO:
1. Amendment.
Title 11, "Vehicles and Traffic", Chapter 11.28, of the
Cupertino Municipal Code is hereby amended, by the addition of a
new Section 11.28.070, to read as follows:
Section 11.28.070 Enforcement of Parkina Req- -
ulations in Private Parking Facilities:
A. The City Council of the City of Cupertino hereby find5
that there are privately owned and maintained off-street parkinq
facilities, as described in paragraph E, below, within the City of
Cupertino that are generally held open for use of the public for
purposes of vehicular parking.
B. Pursuant to the authority granted by California Vehicle
Code 521107.8, the provisions of California Vehicle Code §22507.8
(orohibiting parking in zones reserved for handicapped parsons),
shall apply to and within the areas described in paragrapt E below.
C. Notwithstanding the provisions of paragraph A, above,
this Ordinance shall not apply to any off-street parking facility
described in paragraph E, below, ~nless the owner or operator has
caused to be posted in a conspicuous place at each entrance to such

off-street parking facility a notice not less than 17 by 22 inches
in size with lettering not less than one inch in height, to the
, effect that such off-street parking facility is subject to public
traffic regulations and control.
~ D. This Ordinance was enacted after a public hearing
thereon and ten (10) days prior written notice to the owner and
operator of the privately owned and maintained off-street parking
facility involved.
E. The off-street parking facilities within which the
provisions of this ordinance shall apply are described as follows:

F. Any regularly employed and salaried Deputy Sheziff
of the County of Santa Clara, and any regularly employed and salaried
Code Enforcement Officer of the City of Cupertina, may issue a notice
of violation for any vehicle illegally parked in a space designated
for the exclusive use of the handicapped pursuar~t to California
Vehicle Code Section 21107.8. ~
. 2. Urgency.
This ordinance shall take effect immediately upon enact-
ment as an urgency measure, due to the existing lack of and urgent
necessity to provide reserved and safe access of handicapped persons
to the premises herein described. It is hereby found and declared
that this urgency measure is a necessary protection of the health and
