WESTERLY OF EL PRADO WAY THE CITY COUNCIL OF THE CITY OF CllPERTINO DOES ORDAlN AS FOLLOWS: WHERFAS, on December 6, 1978, an application was filed by Cupectino Knolls (Eureka Federai Savings b Loan) for the rezoning of property from P(Planned Development vith residential use inter.t) to RHS (Residential Hillside-Slope Densi[y) zone; and FIHEREAS, the Planning Commission determined that the rete~tion of the Planned Development zoning district for the property would be appropriate, and thac a Planned Development vould enable the applicant to develop the property in a single-family cluster pattern and maintain private open space held in common by a homeowners association; and WHEREAS, upon due notice and af[er one public hearing [he Planning Com- mission recoc~ended to the City Council [hat the Planned Develapment Zoning Ordinai~ce No. 728 be amended; and WHEREAS, the property to be considered is presently in a P(Planned Develop- men[ vith residential use in[ent} zone; and W}iEREAS. a map of the subject property is attached hereto as Exhibit "B" ~ as a proposed amendment to the Master Zoning Map of the City of Cupertino. i NOW, THEREFORE, BE IT ORDAINED ~S FOLL047S: I Section 1. The property is more clearlq defined by the map labeled Figure 1. The "Voss Aveaue ~ Property Coaceptual Plan" vas initiated to remedy the gross inconeistency becWeen che property's existiag R3-2.2 zoning classification and the General Plan • designation of 0-4 units per gross acre. The Planned Development Zoning Diecrict is ucilized as the zoaiag tool. to effeccuace the zoning consistency because the district pera~.te a great deal of flexibi2lty procedurally and in terms of site planning, which is extremelq iaportant in a hillside si[uation. This conceptual plaa represeacs the iaitial step in the approval procesa for subsequent development of the subject property. As stated ia Sectioa 5.2 of the Planned Developmeat Zoning Ordinance, a Citv initSated conceptual plaa need not contain all of che iaformation concaiaed in a privately submitted plan but shall contain sufEicient iafo rsatlon to define the land use type, intensity, primary street sqstem aad coa~uaitq design objectives to guide the property ocrner in the preparation of either a supplemental conceptual zoning plan or a use permit which is the second procedural step in planned development approval process. The Voss Aveaue Conceptual P1an con9lsts of a series of laad development policies as well as a conceptual site plan. Both the site plan and policy statemeacs are general. The iatent being to defiae the land use type aad a relatively broad densicy range vhich ref2ects the approved Geaeral Plan. The iateat of the plan ie to develop geaeral land use guides and permit the property owner and/or sub- sequent developer to submit a more defiaitive development proposal. Land Use and Site DesiRn Policies The conceptual plaa embodies land use and site and buildiag deslgn policies vhich have che saae force of 2av as conditions of approval associaced vith privately submitted and appraved Planned Developmeat 2oning Districts. The policien or conditions are geaeral in nature. 2fore definitive conditiona shall be developed when a subsequent private development proposal is reviewed. Conditions of acproval 1. The zoning approval is based upon the zoning sketch plan Labeled Figure 1, Che conceptual development plan labeled Figure 2, the 1-14 City of Cupertino Standard Conditions of Approval, aad the special conditions of approval enumerated below. 2. The approved land use is single-familp residential with aa allowed inteneity range based upon [he aoplication of t:~e ~i-Acre Foothill `Sodified Slope-Densitq Formula. The precise development density and patte m shall be determined ia con,junction a~ith a subeequent privately sub~itted concepcual plaa zoning a~eadment or a use permit. Said investigation shall aid in the determination of density and site desiga by evaluating the stability of the proposed buildiag sites vith respect to slope atability and seismic hazards. The report shall address itself to the follwing areas of specific concerns. 1. A general statemeat of the geologic setting of the eite vith respect co mapped traces of che BerTOCal and/or :bnta Vieta faults. 2. an iavestigation shall be coaducted to establish that scructures srill not be placed across aa active rupture surface.
