Ordinance 909 . . • i ORDINANCE NO. 909 AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING • SECTION 8.08.240 OF THE CUPERTINO MUNICIPAL CODE, RELATZNG TO DOG LICENSE FEES, AND DECLARING TAE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: 1. Amendment. Section 8.08.240 of the Cupertino Municipal Code is hereby amended to read as follows: "8.08.240 Do License--Fees. A dog license fee of twelve dollars ($12. per annum s a e pa d for each doq within the City, except that the fee for a spayed female or neutered male shall be six dollars ($6.00). The director of public health or his desiqnated rep- resentative may require the submission of a certificate of a licensed veterinarian statinq that a dog has been spayed or neutered prior to issuance of a license at the lesser fee. An additional fee of six dollars ($6.00) shall be paid for a license purchased more than sixty (60) days after notice to the owner to obtain a license or sixty (60) days after expiration of a license. Licenses and tags for dogs used principally for the purpose of guiding persons with defective eyesight and for dogs used in law enfozcement aqencies shall be issued upon request without charge. Dog owners who have attained the aqe of 65 years and own only one (1) dog shall not be required to pay annual renewal license fees for the one (1) dog, provided the doq is spayed or neutered or a veterinarian certifies that the dog cannot be spayed or neutered for health reasons. 2. Urgency Clause and Effective Date. This ordinance shall take effect immediately as an urgency measure, it being necessary for the continued protection of the public health, safety and welfare of the inhabitants of the City of Cupertino for the followinq reasons: The Department of Public Health of the State of California has found that rabies exists in the County of Santa Clara; the County of Santa Clara has adopted appropriate regulations and has the facilities to pre- vent the spread of rabies among animals and to avoid the possibility of human beings becoming infected with this desease; the County of Santa Clara heretofore has administered and enforced said requlations for and on behalf of the City of Cupertino; said regulations have been amended with an effective date, as to doq license fees of January 1, 1979 : and to provide the continued protection of the inhabitants of the City of Cupertino, it is necessary that this ordinance take effect immed- iately. , • ~ , ' INTRODUCED and ENACTED at a regular meetinq of the City * Council of the City of Cupertino on the tad day of Jaauary, 1979, by the followinq vote: Vote Members of the City Council A'tES: Meyers, 0'&eefe, Rogers~ Spazks, Jackson NOES: None ABSENT: Nona ABSTAIN: Nonn APPROVEDi i F _ r; ty a t o ATTEST: ~ d~ ty e1 Deputy -2-
