THE CITY COONCIL OF THE CITY OF CUPERT L'IO DOES ORDAIN AS FOLLOGS;
6iHEREAS, on June 23, 1978, an application was filed by May Iaveatmeat
Compaay (Application 10-Z-76, Reviand), recommending approval of ravisioa
to the original zoning plaa to permit extension of rear yard feaces iaco
che common area; and
WEiEREAS, upon due aocice aad af[ar one public hearing the Planning Com-
mission reco~eaded to che City Couacil that Che request be granted; aad
WHEREAS, a map of the subject property ls attached hereto a9 Fachibit
"B" as a proposed amendmeat to the Ma~ter Zoniag Map of the City of Cupertino.
vOK, THEREFORE, BE ~ ORDAINED AS FOLLOWS:
Section 1. That che revision to the original zoning plaa be approved
ta permit extension of rear qard feacea into che coirmon area, sub~act to
conditions listed ia attached Eahibit "C", and that Exhibit "B" attached
hereto is made part of the :Yaster Zoniag Map of the City of CuperLino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.

CONDITIONS:
1. That the Covensata~ Conditiona and Raetrictiona o£ Tract No. 5915 be
properly amended to allow tha homeormers asaociation to grant said ease-
meata as auggeated in the letter from Mr. Robezt M. Cavallaro, Branch
Attorney for Lavyera Title Ineurance Corporation dated April 4, 1978.
2. That tha approval 18 for che modification of fence locations on Lota 19
through 27 as submitted by the applicant. The fence adjuatment on Lot
6 ia aot approved. The applican[ ehall submit a reviaed plan which
reflecta the Exhibit A-1 as approved by the Pianning Co~ission. The
reviaed plan should reflect the original intent of matataining the viev
co r
zidor through Lota 6 and 7 to the common open apace area beyond.
3. The easements shall be approved by the homeownera aeaociation.
