AN ORDINANCE OF TtiE CITY OF CUPERTINO AMENDING CHAPTER 16.04
OF TNE CUPERTINO MUNICIPAL CODE BY ADOPTING THE "UNIFORM
BUILDING CODE"., 1976 EDITION AND APPROPRIATE EXCEPTIONS

THE CITY COUNCIL OF THE CITY OP CUPERTINO DOES ORDAIN AS FOLIAWS:
I Chapter 16.04 of the Cupertino Municipal Code is hereby amended
to read as folIows:'
16.04.010. Adoption of Uniform Building Code, 1976 -
The Building Code for the City shall be the 1976 Edition of the
Uniform Building Code, Parts I~o RII inclusive and Appendix, except Chapter
70, as compiled and published by the Internatioaal Conference of Building
Officials. Said Uniform Building Code, three copies of vhich have been filed
for use and exnmination by the public in the office of the Ci[y Clerk 3a hereby
referred to, and, except as to omissions, amendments and additions, hereinafter
noted, ishereby adopted aad made a part hereof, [he same as if fully set forth
in this chapter.
16.04.020. Organization and Enforcement
Section 204 amended--Board of Appeals: In order to determine the
suitrbility of alternate materials and methode of construction and to provide
for reasonable interpretations of the provisions of this Code, there shall be
and is hereby created a Board of Appeals, consis[ing of five members vho are
qua2lfied by experience and training to pass upon matters pettaining to building
conatruction installations and materiala. The Building Official shall be an
ex-officio member and ahall act as Seczetary of the Board. The Board uf appeals
shall be appointed by the Hayor, sub3ect to the approval of the City Council,
and ahall hold office at his pleasure. The Board shall adopt reasonable rules
and regulations for conducting its investigations and shall render all decisions
and findings in vriting to the Building Official. With a duplicate copy [o the
appellant, and may recommend to the City Council such new legislation as is
conaistent therewith. The same personnel of the Board of Appeals appointed
under this Code may act as the Board of Appeals under the other building
cons[ruction uniform codes. In the event an Appeals Board is not appointed by
the legislative body, the Council shall serve as said Appeals Soard.
1G.04.030. Permits and Inspections

Section 304 (e) amended--Other Inspections: In addition to the
called inspections specified above, the Building Official may take or require

any other inspections of any conetruction work to ascertain compliance aith the
provisions of this Code and other lawa which are enfozced by thu Building
Department. For the purpose af determining compliance with Section 104 (h),
che Building Official may cause any structure to be reinspected. If any in-
spection ie made a[ the request of any individual, property owner or lending
ins[itution, a fQe equal to the cost of making auch inapection ahall be charged
vith a minimum fee of $50.OU.
16.04.040. Res[riciions in Fire Zones
II Section 1601 (a) amended--Fire Zones Defined: For the purpose
of [his Code. the entire City is hereby declared to be and is hereby established
a Fire District' gnd said Fire District shall be known as Fire Zone No. 3.
16 04 05U E~ccavations, Founda[ions and Retaininq Walls
Section 2907 added--General:
1. Minimum of two (2) 1/2 inch reinforcing roda continuous in .
foundations are required.
16.04.060. Nearing
This Ordinance shall. after first reading, be echeduled for public
hearing as provided in Section 50022.3 of [he Government Code. Notice of
hearing ehall be published pursuant to Section 60066 of the Government Code
in the~Cupertino Courier. Copies of the Uniform Building Code and this Ordinance
shall 6e on file with the City Clerk and open for public inspection.
16.04.070. Violation - Penalty
Any person, firm, corporation, partnerahip, or co-partnerahip who
vilfully violates any of the proviaions, or fails to comply vith any of the
mandatory requirements of this Ordinance ia guilty of an infraction, and upon
conviction thereof, shall be punishable as provided in Chapter 1.12 of the
Cupertino Municipal Code, except that no[hing herein contained shall be deened
to bar any legal, equitable, or su~ary remedy to which the City of Cupertino
or other political subdiviaion, or any person, firm, corporation or partner-
ship may be o[herwise entitled, and the City of Cupertino or any other political
subdivision, or person, firm, corporation or partnership may file a suit in
the Superior Court of the County of Santa Clara, to reatrain, or enjoin any
attempted or proposed subdivision, or acts, in violation of this Chapter.
