AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING CHAFTER 16.20
OF THE CUPERTINO HUNICIYAL CODE BY ADOP2ING THE "UNIFORlt
PLUMBING CODE.", 1976 EDITION AND APPROPRIATE EXCEPTIONS

Chapter 16.04 of the Cupertino Municipal Code ia hereby ame~ided to read

Section 16.20.U10 Adopted bv Reference •
That certain code entitled "International Association of Plumbing
Officials Uniform Plumbing Code". 1976 Edition, hereinafter referred to in
thls Ordinance as the "Uniform Plumbing Code, 1976 Edition", three (3) copies
of which are on file in the office of the City Clerk for use and examination
by the public, excepting those provisions hereinafter noted is hereby adopted
by zeference.
Section 16.20.020 Name Insertion
The names "Cupertino" and "California" ahall be inserted in the
appropriate places provided therefore in each and every section of said Uniform
Plumbing Code, 1976 Edition, wherein either the name of the City or State is
left blank. ~
Sec[ion 16.20.030 Incorvorationa and Amendments
New aections incorporated in[o and amendmenta to the Uniform Plumbing
Code, 19J6 Edition (the aection numbers hereafter used will cortespond to thc
numbers in the Uniform Plumbing Code, 1976 Edition, or vill be inserted in the
most appropriate sections thereof) are as follovs:

ADMINISTRATION
Section Z0.3 - Violation - Penalty ~ '
Any person, firm, corporation, parcnership, or co-partnerahip who
vilfully violates any of the provisions, or fails to comply with any of the
mandatory requirements of this Ordinance is guilty of an infraction. and upon
conviction thereof, shall be puniahable as provided in Chapter 1.12 of the
Cupertino Municipal Code, except [hat nott~ing herein contained shall be'deemed
to bar any legal, equitable, or summary remedy to which the City of Cupertino
or other political subdivision, or any person, firm, corporation or par[ner-
ship may be othen+ise entitled, and the City of Cupertino or any other political
subdivision, or p~rson, firm, corpora[ion or par[nership may file a suit in
the Superior Court of the County of Santa Clara, to restrain, or enjoin any
a[tempted or proposed subdivision, cr ac[s, in violacion of this Chap[er.

The iasuance or gran[ing of a petmit oz approval of plnns and spec-
ifications ahall not be deemed or conetrued to be a permic for, or a~ approval
of, any violation of any of the proviaiona of Lhis code. No permit presuming
co give authority to violate or cancel the provisions of thie code shall be
valid, except insofar as the vork or use which it authorized is lawful.
The iasuance or granting of a permit or approval of plans ahall
not prevent the Administrative Authority from thereafter requiring the cor-
rection of errors ia said plans andepecifications or from preventing construction
operations being carried on thereuuder when in violation of this code or of
nny other ordiriance~or from revoking any cer[ificate of approval when issued

' Every petmit issued by the Administrative Au[hority under the pro-
visions of this code ahall expire by limitation and become null and void, if
[he work authorized by such permit is not commenced within one hundred taeaty
(120) days from date of such permit, or if the work authorized by such permit
is suspended or abandoned at~any time after the work ie commenced for a period
of one hundred twenty (120) days. Before such work can he recommenced a nev
pcrmit shall be firat obtained to do so, and the fee therefore shall be one-
h:~lf the amount required for a new permit for such vork, provided no changes
have been made, or will be made in the original plans and specifica[iona for
xuch work; and provided, further, that such suspension or abandonment has not
c•x~eeded one (1) year.

Section 20.14 - Baard of Appeals
Section 20.14 of the Uniform Plumbing Code is hereby amended to
read as follovs:
In order [o determine the suitability of alternate ma[erials and
methoda of conatruction and to provide for reasonable in[erpretationa of the
provisions of this Code. there ahall be and is hereby created a Board of Appeals,
consisting of five members who are quslified by experience and training to paes
upon matters pertaining to building construction installations and materials.
The Building Official shall be an ex-officlo member and shall act as Secretary
of the Board. The Board of Appeals shall be appointed by the Hayor, subjeet
to the approval of Che Clty Council, end shall hold office at hia pleaeure.
The Board shall adnpt reasonable rules and regulatione for conducting its
inveatigations and shall render all decisions and findinga in writing to the
Building Official witi~ a„~pli:.ate copy to the appellant, and may reco~end
to the City Council such nesa legislation as is conaistent therewi[h. The same
pereonnel of the Board of Appeals appointed under this Code may act as the
Board of Appeais under the other building construc[ian uniform codes. In the
event an Appeals Board is no[ appointed by the legislative body~ the Council
shall serve as said Appeals Board. -
Section 16.20.040 Hearing
This Ordinance shall, after first reading, be echeduled for public
hearing as provided in Section 50022.3 of the Government Code. Notice of hearing
sfiall be published pursuant to Section 6066 of the Covernment Code in the Cuper-
tino Courier. Copies of the Uniform Code and this Ordinance shall be on file
with the City Clerk and open for public inspection.
