ORDINANCE N0. 831
AN 0&DINANCE OF THE CITY OF CUPERTINO RECIJLATING STOPPING,
STANDING OR PARKING ON PRIVATE STREETS, AND PROVIDIpiG FOR
SIGNS NOTIFYING TfiE PUBLIC THEREOF, AND FtTRTHER pRpVIDING
FOR YENALTIES FOR VIOLATION TliEREOF
THE CITY COUNCIL OF TFiE CITY OF CUPERTINO DOES,ORDAIN AS FOLLOWS:
~ SECTION 1. DEFINITIONS.

Section 1.1: Highway: A"highway", for the purpoaes of this Ordinance
shall be any private roadway upon which Sectiona of the Vehicle Code
been made applicable by the City Council of the City of Cupertino.
Section 1.2: Holiday: "Holidays" are: The firet day in January, Memorial
Day, Independence Day, Admissioa Day, Labor Day, Thanksgiving Day, and Christmas.
Section 1.3: Intersection: An "intersection" is the area em6raced within
the prolongation of the lateral curb 11aes, or, if none, then the lateral boundary
lines of the roadvays, of two highways which join one another at approximately
right angles or the area vithin vhich ~ehicles traveliag upoa different highways
joining at any ocher angle may come in coaflict.
Section 1.4: Park: "Park" is to stand or leave etanding any vehicle,
whecher occupied or noc, otherwise than temporarily for the purpose of aad while
actually engaged in loadiag or unloading or passengera or materials.
Section 1.5: Parkway: A"parkvay" is that portion of a street other than
a roadway or sidevalk.
Section l.b: Roadway: A"roadway" is that portion of a highway improved,
designed. or ordinarily used for vehicular travel.
Section 1.7: Sidewalk: A"sidevalk" is that poztion of a highway, other
than the roadvay, set apart by curbs, barriers, markings or other dellneation
for pedestrian travel.
Section 1.8: Stop or Stopping: "Stop or atopping" when prohibited
shall mean any cessation of movement of a vehicle, whether occupied or not.
except when necessary to avoid conflict with other traffic or in compliance
with the direction of a police officer or official traffic control device or
signal.
Section 1.9: Street: A"street" is a highvay.
SECTION 2. CURB MARKINGS AND SIGNS TO INDICATE NO STOPPING AND PARKING REGU-
LATIONS.
Section 2.1: The City Traffic Engineer is hereby authorized, aubject
to the pzovisions and limitations of thia Chapter, to approve, and when required
herein shall approve, the following curb markings or curb markings and aigns,
to indica[e parking or standing regulations, and said curb markings shall heve
che meanings as hereinafter set fozth.

Section 2.2: No Parkinrt Zone: Red shall mean no atopping, standing or
parking at any time except as permitted by the Vehicle Code, and except that
a bus may atop in a red zone marked or signed as a bus zone.
Section ?.3: Loadina 2one: Yellow ahall mean no stopping, atanding or
parking for aay purpoae other thaa the loading or unloading of pasaeagera
or materials to and from commercial vehicles making commercial deliveriea, pra-
vided that the loading or unloadiag of passengera shall not consume more than
three (3) minutea, nor the loadiag or unloading of materials more than twenty
(20) minutea, unlesa the City Traffic Engineer hae approved signa to be posted giving
notice of differeat period in which the restrictions shall apply.
Section 2.4: Pasaenqer LoadinQ Zone: White ehall mean no atopping,
standing or parking for aay purpose other than the loading or unloading of
passengers, which shall not exceed three (3) minutes, unleas the City Traffic
Engineer has approved signa to be poated giving notice of a differenC period
in vhich the reatrictions shall apply.
Section 2.5: Restricted Parking Zone: Green ahall mean no stopping, standing
or parking for longer than twelve (12] minutea at any time between 7:00 a. m. and
6:00 p. m. on any day except Sundays and holidays, unleas the City Traffic
Engineer has approved signa, markiag or curb markings and aigns to be posted
giving notice of a different period in which the restrictions apply.
Section 2.6: Handicapped ParkinR Zone: Blue ahall mean ao stopping,
standing or parking except for vehicles of physically handicapped peraons.
SECTION 3. PURPOSE.
Section 3.1: The proviaiona of this Ordinaace prohibiting the stopping,
standing or parking of a vehicle shall apply at all times, or at those times
herein specified, except whea it is necessary either to stop a vehicle to avoid
conflict With other traffic, or in compliance with the directions of a law en-
forcement officer or official traffic control device.
Section 3.2: The provisions of this Ordinance imposing a time limit on
stopping, standing or parking shall not relieve any person from the du[y to
observe other and more reatrictive provisione of the Vehicle Code of the State
of California, or the ordinances of the City prohibiting or limiting [he stop-
ping, standing or parking of vehicles in specified places or at apecified timea.
SECTION 4. STOPPING, STANDING OR PARKING PROHIBITED IN CERTAIN PLACES
Section 4.1: Obedience to Si~tns: Whenever signs have been erected,
pursuant to Section 2, no peraon shall stop, atand or park any vehicle in the
area designated by such aigne.
Section 4.2: ParkinR Space Markings: The City Traffic Engineer ia
authorized to approve parking space markings to indicate parking spaces adjacent
to curbings where authorized parking is permitted. When such parking space
markings are placed in the highway, subject to other and more restrictive
limitations, no vehicle shall be stopped, left s[anding or parked, other
than vithin a single space~ unless the size or shape of such vehicle makes
compliance impossible.

Section 4.3: AuthoritY to Establish LoadinA Zoaes: The City Traffic
Engineer ie hereby authorized to approve loading zones and passenger loading
zones ia front o£ any hall or place used for the purposa of public asaembly.
Section 4.4: Loading Zones, Marking: Loading zonea ahall be indicated
by a ye11oW paint line upon the top and face of all curbs within auch zonea.
Section 4.5: Pasaenger LoadinS Zonea: Pasaeager loading zones ehall
be indicated by a whlte 11ne etenciled with black letters "PASSENGER LOADING
ONLY" upon the top of all curba in said zones.
Section 4.6. Authority to Establish Pazkin6 SDaces for the Excluaive
~ Uae of Handicapped Peraona; Markinga: The City Traffic Engineer is hereby
authorized to approve parking spacea for the exclusive use of vehicles vhich
display a distinguishing license place or placard iasued by the California
Department of Motor Vehicles to hendicapped peraona or to disabled veterane
purauant to Sections 22511.5 and 9105 of the California Vehicle Code. All
parking spacea so desigaated shall be identified by blue paint on the curb or
edge of the paved portioa of the atreet adjacent to the space. In addition
to blue paint, the space may also be indicated by aigna or other euitable
means.
SECTION 5. PARKING REGiTLATIONS.
Section 5.1: Parking Prohibi[ed AlanR Certain Streets: No person shall
stop, s[and or park any vehicle as defined in the Vehicle Code of California
on any day vithia the City of Cupertino, to wit:

SECTION 6. PENALTIES.
Section 6.1: Aay peraon, firm or corporation violating any proviaion
of this Ordinance ahall be deemed guilty of a misdemeanor, and upon conviction
thereof, shall be puniahed by a fine not to exceed Five Hundred Dollars ($500)
or by imprieonment ia the County Jail not to exceed six (6) montha for each
violation, or by both auch fine and imprisonment.
SECTION 7. SEVERABILITY CLAUSE.
Section 7.1: If any aection, subsection, sentence, clauae or phrase
of thia Ordinance is for any reason held to be unconatitutional, such decision
shall no[ affect the validity of the remaining portions of this Ordinance.
The legilative body hereby declarea that it vould have pasaed this Ordinance
and each section, subaection, aeatence, clauae or phrase thereof, irreapective
of the fact that any one or more aection, aubaection, aenteace, clause or
phrase be declared unconstitutional.
SECTION 8. ENFORCEMENT.
Section 8.1: The City Clerk is hereby authorized and instructed to file
a certified copy of this Ordinance upon ita becoming effective wi[h the Sheriff's
Office of the County of Santa Clara, State of California.
SECTION 9. PUBLISHING CLAUSE.
Section 9.1. The City Clerk is hereby authorized and directed to cause
a certified copy of this Ordinance to be publiahed at least once within fifteen
(15) days after its enactment in the Cupertino Courier, the official newapaper
of [he City, published and circulated within the City of Cupertino.
