Sections 1.12.010 and 1.12.020 of Chapter 1.12 of the , Cupertino Munici~al Code are her;eby amended to read in full as follows: 1.12.010 Infraction. A. Whenever in any ordinance o£ the City, inc u ing bot ordinances codified in this code, and ordinances not codified in this code, or in any rule, regul- ation, order, or condition imposed upon any permit issued or promulgated pursuant thereto, any act is prohibited, or is made or declared to be unlawful, or an offense or a misdemeanor, or the doing of any act is required, or the failure to do any act is declared to be unlawful or a misdemeanor, the violation of any such provision of any ordinance of the City, or of any such , rule, requlatior?R order,.or condition imposed upon any permit by any;'parson,`firm or corporation, whether as.principal, agent, employee or otherwise, is hereby made an infraction, rather than a misdemeanor, and may either be prosecuted by city authorities in the name of the people of the state of California, or redress- ed by civil action. H. Every violation determined to be an infraction is punish- able by the following fines: , 1. A fine note exceeding fifty dollars for a first violation; ~ 2. A fine not exceeding one hundred dollars for a second violation of the same ordinance within one year; and, 3. A fine not exceedinq two hundred fifty dollars for each additional violation of the same ordinance within one year. . 1.12.020 Each da a se arate offense. The Code Enforcement Officer, or such~person aut or ze to act in that capacity during his periods of absence or leave, is designated Enforcement Officer, and charged with the duty of enforcement, of the ordinances of the City, and the parkinq regulations of the California Vehicle ~ Code. Such desiqnation•shall not relieve any other officer of the Cit;~ who, in any other ordinance of the City, is designated as the Enforcement Officer thereof, from his duty to enforce ~ such other ordinance. With respect to any such other ordinances, the Code Enforcement Officer, or.such person authorized to act in that capacity during his periods of absence or leave, shall discharge his duties under this chapter in cooperation with any such other officer. ~ ~i - 2.30.020 Warrantless arrest power. The Code Enforce- ' ment Of°icer, or such person authorized to act in that capacity during his periods of absence or leave, is authcrized and empower- ed to arrest a person without a warrant whenever he has reasonable cause to believe that the person to be arrested has coramitted either an infraction or a misdemeanor in his presence which is a violation of any ordinance of. the City or parking regulation oi . r .
