AN ORDINANCE OF THE CITY OF CUPERTINO A,%!ENDING SECTION 1
OF ORDINANCE NO. 2 BY PREZONING -A2PROXI.MAT1ELY 3. 29 ACRES
FROM SavTa CLARA COUNTY A ZONE TO CITY OF CUPERTINO
• R1-100 ZONE; LOCATED AT THE WESTERN TERbIINUS OF LINDY
LANE
THE CITY COUNCIL OF THE CITY OF C,,T ERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on July 10, 1977, an application was filed by John P. Dozier
,'application 17-Z-77) for the prezoning of property from Santa Clara County
A (Agricultural) Zone to City of Cupertino R1-100 (Residential, single-family,
100,000 sq. ft. per dwelling unit) Zone; and
;wMREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Prezoning be granted; and
WHEREAS, the property to be prezoned is presently in a Sanca Clara County
A (Agricultural) Zone; and
'WHEREAS, a man of the subject property is attached hereto as Exhibit
"A" as a prcposed amendment to the !Master Zoning Map of the City of CuPec-
tino;
NOW, THEREFORE. 3E IT ORDAINED AS FOLLOWS:
Section 1. That the following described property be and herebyis pre-
zoned to a City of Cupertino R.1-100 (Residential, single-family, 100,000 sq.
per dwelling unit) Zone, subject to conditions set forth in Planning Com-
mission Resolution No. 1733, attached hereto as Exhibit "B" and that Exhibit
"C" attached hereto is made part of the Master Zoning Map of the City of Cuper-
-no .
All that certain real property situate in the County of Santa Clara,
State of California, approximately 3. '9 acres, located at the
western terminus of Lindy Lane, more fully described in attached
Exhibits '.A." and "C".
Section = This ordinance shall take effect and be in force thirty (30)
ays after its passage.
INTRODUCED at a regular meeting of the City Council of the City of Cuoer-
_iao this 3rd da;; of October , 1977, and ENACTED at a regular meeting
of the City Council of the City of Cupertino this l7thday of October 1977,

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECONME,
ING THE GRANTING OF A ZONE CHANGE
WHEREAS the attached application has been submitted to the City of
Cupertino requesting a change of zone in the zoning regulations of the
City, as stated on Page 2; and .
WHEREAS the Planning Commission has held at least one public hearing
in regard to the application on the date as noted on said application;
and
WHEREAS the Planning Commission has duly considered and heard all
evidence submitted in regard to said application; and
WHEREAS the necessary public notices have been given as required by
the Zoning Ordinance of the City of Cupertino;
NOW, THEREFORE, BE IT RESOLVED:
That the Planning Commission finds that the proposed zone change:
a) Encourages the most appropriate use of land,
b) Conserves and stabilizes the value of property,
c) Provides for adequate open spaces for light and air,
d) Permits adequate control of fires,
e) Promotes the health, safety and public welfare,
f) ?rcvides for the orderly development of the City,
g) Is advantageous to the property and improvements in the zoning
district and neighborhood in which the property is located.
That said Planning Commission, therefore, reports favorably to the City
Council in the matter of granting said zone zhange.
