AN ORDINANCE OF THE CITY OF CUPERTINO A2fENDING SECTION 1
I OF ORD2NANCE N0. 2 BY RE20NING APPRO:(IMATELY .405 ACRES
FROM CG ZONE TO P ZONE; LOCATED SOUTHERLY OF AND ADJA-
CENT TO STEVENS CREEK BOULEVARD APPROXIMATELY 116 FEET
EASTERLY OF BLANEY AVENUE
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on July 14, 1977, an application was fi2ed by South Couaty
Development Corporation (Applicatioa 16-Z-77) for the rezoning of property
£rom CG (General Commercial) 2one to P(Planned Development with General
Commercial intent) Zone; and
WHEREAS, upon due notlce and after one public hearing the Planning Com-
misaion recommended to the City Council that the Rezoning be granted; and
W[~REAS, tha property to be rexoned is preaently in a CG (General Coaaaer-
cial) ~one; and
WHEREAS, a map of the aubject property ie attached hereto as Exhibit
"A" as a proposed amendment to the Master Zoning Mep of the City of Cuper-
tino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property be and hereby ia
rezoned [o a P(Planned Developmene with General Commercial intent) Zone,
sub~ect to conditions set forth in Planning Commisaion Resolution No. 1136,
attached hereto as Exhibit "B" and thac Exhibit "C" attached hereto is made
part of the Master Zoning Map of the City of Cupertino: '
All that certain real property situate in the City of Cupertino,
County of Santa Clara, S[ate of Califomia, approximately .405
acres, located southerly of and adjacent to Stevena Creek Boule-
vard approximately 116 feet easterly of Blaney Aveaue, more fully
described in attached Exhibite "A" and "C".
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.
LRTRODUCED at a regular meeting of the City Council of the City of Cuper-
tino this 3rd day of October , 1977, and ENACTED at a regular meeting of

All that certain real property ia the City of Cupertino, Cuunty of Santa
Clara, State of California, described as follows:
Portion of Lot 5, as shown upon that certain map entitled, "Map of the Price
Subdivision", which map was filed for record in the office of the Recorder
of the County of Santa Clara, State of Califomia, on December 27, 1911 in
Book N of Maps, at page 74, and more particularly deecribed as followe:
Beginning at the northeast corner of said Lot 5; thence south 89°36' wes[
along the northerly line of said Lot 5 a distance of 98.76 feet to the northeast
coraer of that certain parcel of land conveyed in the deed to David P. Vienna
I et ux, recorded June 5, 1967 in Book 7740 Official Recorda, page 675, Santa
Clara County Records; thence south along the eastezly line of said parcel of
land 193.64 feet to a point in the southerly line of said Lot S; thence easterly
along said southerly line of Lot 5 a distance of 98.76 feet to the southesst .
corner of said lot; thence north along the easterly line of said Lot 5 a discance
of 193.64 feet to the point of beginning.
Excepting therefrom the interest conveyed to the City of Cupertiau by deed
recorded November 20, 1962 ia Book 5797 of Official Records, page 234, in aad
co that portion of said property within the following deacribed tract of land:
Beginning at the poiat of intersection of the southerly line of Stevens Creek
Boulevard, 40.00 feet wide. and the easterly line of Blaney Avenue as it formerly
existed 40.00 feet vide, said poin[ also being the northwesterly corner of
that certain Lot 5, as shown upon that certaia map entitled, "Map of the Price
Subdivision being Lat 4 of the Craft Eatate Partitioa". as said County
of Santa Clara, State of California, on December 27, 1911 in Sook "N" of maps,
page 74; thence from sald point of beginning souch 0°13' eaet 193.64 feet to the
southwesterly corner of said Lat 5; thence along the point on a line parallel
to and distant 10.00 feet easterly, measured at right anglea to said easterly
line of Blaney Avenue; thence along said parallel liae north 0°13' weat 148.74
feet to a point; thence northeasterly along a curve to the right, tangent
to the last described course, with a radius of 30.00 feet, central angle of 89°49'
and curve length of 47.03 feet to a point on a line parallel co and distant 15.00
