THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAI,I AS FOLLOWS:
WHEREAS, on February 8, 1977, an application Was filed by Pacific Valley
Bank (Application 4-Z-77) for the rezoning of property from CG (General
Commer~ial) Zone to P(Planned Development with commercial and professional
office uae intent) Zone; and
WHEREAS, upon due notice and after one pub2lc hearing the Planning Com-
mission recommended to the City Council that the rezoning be granted; and
j WHEREAS, the property to be rezoned is presently in a CG (General Com-
mercial) Zone; and
WHEREAS, a map of the subject property is attached hereto as ExhibiCs
"A" and "B" as a proposed amendment to the MasCer Zoning Map of the City of
Cupertino,
NOW, TIiEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property be and hereby ia rezoned
to a P(Planned Development with commercial and profesaioaal office use
intent) Zone, sub,~ect to conditione set forth in Planning Commisaion Resolu-
tion No. 1670, attached hereto as Exhibit "C" and that Exhibits "A" and "B"
attached hereto are made part of tha Master 2oning Map of the City of Cuper-
tino:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of Califomia; 2.55 acres
located in the northeasterly quadrant of North De Anza Boulevard
and Stevena Creek Boulevard, more fully described in attached
EXhiblt9 "A'~, ~~B~~ azid ~~C".
Section 2. This ordinance ahall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of

of land shown upan the Record of Survey map filed in Book L00 of Mapr~ at page

to the Citq Attomey, agreeing to provide reciprocal parking and ingress/
egzess easements to the properties designated on tentative parcel map
2-T:1-77 as owned by vational Life and accident Insurance Company, and
Baer Property (see Exhibit r1 0£ Application 2-T:i-77) at such time as
the City can require the same of said property owner/s.

Additlonally, the agreement shall atate that [he applicant will provide
reciprocal parking and ingresa/egress easemencs with the adjoining
Catholic Church property at such time as the ovner of the St. Joaeph's
Cacholic Church dedicates and/or improves che church frontage along
North De Anza Boulevard and agrees to provide reclprocal parking and
ingresa/egress eaaemencs to che applicanc. The agreement ahauld state
thac it is underatood that said easemeats are to be mutually agreeeble
to both parties. The precise location of said ingress/egresa easements
with the Church property to tha noreh and eaat ahall be decermined and
based upon future negotiacioas concerning an enlarged right-oEwaq area

18. This approval is for a two-phase project which includes a 10,000 ~q. ft.
building in Phaan One coasiating of 4,000 aq. ft. devoted to a bank
tenant~ and 6.000 sq. ft. for general office uses~ and a 7,000 aq. ft.
• office building in thn Phasse T~+o portion of the development. Ic is
; undaratood chat the Phaan Ttro portion oE this project ~rill incorporate
architecture styling which is similar to the architectural theme pro-
poatd on ehe baak/office structure of Phase One. In addition, che
applieant ahall provide a 50 ft. laadscape setback from Scevens Creek
Saulevard in which no circulation or parking sha11 6e permitted. It
is permissible to allow the building to encroach into the 50 ft. land-
acape aetback provided that the overaSl landscapiag area totals 50 sq.ft.
times street froatage. It is anticipated that a site plan change may be
necesaarq to acco~odate the above provinioas, and ehat che Archicec-
tural aad Site Approval Coimmictee ehall have the ability to make
changes in the aite plsa to acco~odate the above proviaione and to
provide for a more logical circulation aystem.
