HomeMy WebLinkAboutOrdinance 795 0 ORDINANCE NO. 795 AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1 OF ORDINANCE NO. 2 BY PREZONING .06 ACRES FROM SANT_A CLARA COUNTY R2H ZONE AND .09 ACRES FROM SANTA CLARA COUNTY CG ZONE, TOTALING .15 ACRES , TO CITY OF CUFERTINO R1-7.5 ZONE; LOCATED NORTHERLY AND ADJACENT TO PENINSULA BOULEVARD APPROXIMATELY 80 FT. EASTERLY OF THE INTER- SECTION OF GRAND AVENUE AND PENINSULA BOULEVARD THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: WHEREAS , on February 1 , 1977, an application was filed by Reynaldo Perez (Application 1-Z-77) for the prezoning of property fror„ Santa Clara County R2H (Residential, duplex) Zone and from Santa Clara Countv CG (General Commercial) Zone to C?.t:y of Cupertino R1-7.5 (Residential, single-family , 7,500 sq. tt. per dwelling unit) Zone; and .%HEREAS , upon due notice and after one public hearing the Planning Com- mis ion recommended to the City Council that the Prezoning be granted; and WHEREAS , the property to be ,rezoned is presently in a Santa Clara County R2H (Residential , duplex) Zone and a Santa Clara County CG (General Commer- cial) Zone; and WHEREAS , a map of the subject property is attached hereto as Exhibit "A" as a proposed amendment to the Master Zoning Map of the City of Cuper- t ir.o; NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS : Section 1. That the following described property be and hereby is prezoned to a City of Cupertino R1-7.5 (Residential , single-family, 7,500 sq . ft . per dwelling unit) Zone, subject to conditions set forth in Planning Commission Resolution No. 1664, attached hereto as Exhibit "B" and that Exhibit "A" attached hereto is made part of the *faster Zoning `lap of the City of Cupertino : All that certain real property situate in the County of Santa Clara, State of California, . 15 acres , located northerly and adjacent to Peninsula Boulevard approximately 80 ft. easterly of the intersection of Grand Avenue and Penin- sula Boulevard, more fully described in attached Exhibits "A" and "B" Section 2. This ordinance shall take effect and be in force thirty (30) days after its passage. Adams , Chairman Planning Commission ATTEST: 1 r i Robert Cowan Assistant Planning Director �xh ► b � f ',C3 ,� City of Cupertino California RESOLUTION OF THE PLANNING COMISSION OF THE CITY OF CUPERTINO RECOMg.'M- TNG THE GRANTING OF A ZONE CHANGE ATHEREAS the attached application has been submitted to the City of Cupertino requesting a change of Lone in the zoning regulations of the City, as stated on Page 2; and WHEREAS the Planning Commission has held at least one public hearing in regard to the application on the date as noted on said application; and WHEREAS the Planning Commission has duly considered and heard all evidence submitted in regard to said appl-ication; and WHEREAS the necessary public notices have been given as required by the Zoaing .Ordinance of the City of Cupertino; NOW, THEREFORE, BE IT RESOLVED: That the Planning Commission finds that the proposed zone change: a) Encourages the most appropriate use of land, b) Conserves and stabilizes the value of property, c) Provides for adequate open spaces for light and air, d) Permits adequate control of fires, e) Promotes the health, safety and public welfare, f) Provides for the orderly development of the City, g) Is advantageous to the property and improvements in the zoning district and neighborhood in which the property is located. That said Planning Commission, therefore, reports favorably to the City Council in the matter of granting said zone change. -1-
