AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE NO. 3 BY REZONING PROPERTY FROM R1-10ag TO
R1-7. 5 ZONE LOCATED ON THE NORTH SIDE OF MCCLELLAN, ROAD
150 FT. EAST OF STELLING ROAD
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
WHEREAS, on July 2, 1986, an application was filed by H. W. Associates
Investment Company for the rezoning of property from R1-10 (Residential,
Single-family, 10,000 sq. ft. minimum lot size) Zone and RI-ag (Agricultural
Residential, Single-family, 10,000 sq. ft. minimum lot size) Zone to R1-7.5
(Residential, Single-family, 7,500 sq. ft. minium lot size zone; and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted;
and
WHEREAS, the property to be rezoned is presently in a Santa Clara
County R1-7.5, Single-Family, 7,500 sq. ft. minimum lot size Zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be axle
hereby is rezoned to a City of Cupertino R1-7.5 (Single-Family, Residential,
Single-Family, 7,500 sq. ft. minimum lot size) zone; and that Exhibit "B"
attached hereto is made part of the `!aster Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this 6th day of October 1986 and ENACTED at a regular
meeting of the City Council of the City of Cupertino this 27th day
of October 1986 by the following vote:

Description of The Lands of Weber, et ux and
Runph, et al, For The Purposes of Rezoning
All that real property situate in the City of Cupertino, County of Santa
Clara, State of California, being described as follows:
BEGINNING at the intersection of the Northerly line of McClellan Road with the
Easterly line of Stelling Road, said point of intersection being the
Southwesterly corner of Section 13 Township 7 South, Range 2 West, Mount
Diablo Base and Meridian, thence from said point of beginning Easterly along
the said Northerly line of McClellan Road North 890 58' East 371.25 feet;
thence North and parallel with Stelling Road 10.00 feet to the TRUE POINT OF
BEGINNING of this description; thence from said true point of beginning North
342.00 feet; thence parallel with said Northerly line of McClellan Road, Sough
890 58' West 123.75 feet ; thence parallel with said Easterly line of
Stelling Road, North 88.00 feet; thence parallel with said Northerly line of
McClellan Road South 891) 58' West 222.50 feet; thence parallel with said
Easterly line of Stelling Road South 88.00 feet; thence parallel with said
Northerly line of McClellan Road North 890 58' East 98.75 feet; thence
parallel with said Easterly line of Stelling Road, South 330.00 feet; thence
parallel with said Northerly line of McClellan Road North 890 58' East
158.32 feet; thence Easterly along a tangent curve to the right havinq a
radius of 150.00 feet, through a central angle of ill 29' S2•, an arc lenqth

along a tangent curve to the left, having a radius of 150.00 feet, through a
central anqle of 110 29' 52', an arc length of 30.10 feet to the said true
point of beginning of this description.
TOGETHER WITH a strip of land, 13 feet in width, lying Southerly of, and
contiguous to the southerly line of the hereinabove described Parcel described
as North 890 58' East 98.75 feet.
