Ordinance 1368 ORDINANCE' N0.` 1368 ' r: ' .: ''` AN ORDINANCE OF THE'CITY OF CUPERTINO AHENDING SECTION 1 OF ORDINANCE N0. 2 BY REZONING PROPERTY FROM PLANNED OFFICE (OP) TOP (PLANNED DEVELOPMENT WITH HOTEL•INTENT) ' ZONE; LOCATED ON THE NORTHWEST CORNER OF THE INTERSEC- TION OF WOLFE ROAD AND INTERSTATE 280 - THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: WHEREAS, on July 25, 1986, an application was filed by Brian, Kangas, Foulk and Associates (Application 6-Z-86) for the rezoning of property from P (Planned Development with Commercial, Office and Recreatianal'In- tent) and OP (Planned Office) to PD (Planned Development with Hotel Intent) zone; and WHEREAS, upon due notice and after one public hearing the Planning. Commieaion recommended to the City Council that the Rezoning be granted; and WHEREAS, the property to be rezoned is presently in a General Commercial Zone; and WHEREAS, a map of the subject property is attached hereto as Exhibit "B" and as a proposed amendment to the Master Zoning Map of the City of Cupertino. NOW. THEREFORE, BE IT ORDAINED AS FOLLOWS: Section 1. That the property described in attached Exhibit "A" be and hereby is rezoned to a PD Planned Development with Hotel Intent; subject to conditions listed in attached Exhibit "C"; and that Exhibit "B" attached hereto is made part of the Master Zoning Map of the City of Cupertino. PER?IITTED USES A maximum 240-room hotel to permitted, subject to submittal and approval of a definitive development plan in conjunction with a use permit application. Ancillary facilities will also be permitted to the extent they complement and support the primary hotel function. Ancillary facilities may include banquet apace, conference rooms, and coamtercial activities co®non to hotels, such 'as gift shops, flower"ehopa, bookstores, hairdressers, barbera,,7~nd restaurants. ..: 18. bEVELOPNENT`CUIDELINES The definitive development plan for the subject property shall :comply with the following atandardsc • The hotel shall be of a scale and form which insures a harmonious transition between the residential neighborhood to the west and existing and future commercial developments in Vallco Park. - An easement from Pruneridge Avenue"shall provide"access` to the subject property. Access from Wolfe Road and Linnet Lane is prohibited except far possible emergency'accass to--` Wolfe Road. 19. BASE SUILDINC AREA CREDIT TRANSFER Tfie Cupertino General Plan permits a base land use credit of .33 FAR _, for..andustrial, .37 for off ice,. and .25 for, co~ercial..uaea_and..hotel facilities consisting of 1,000 total rooms plus ancillary facilities.
