THEREOF
The City Council of the City of Cupertino does hereby ordain that
Article 5 of Title 18 of the City Code be amended to read as
follows:

~8-1 503 Parcel Mao to Consolidate Lots of Rewrd
Notwithstarrling any provision to the contrary contained in
this article, upon request of the legal owner(s) of
oontiguaus paLr_e1s of lard, the Director of Planning and
Development, without approval of the Planning C~issicn but
with review and public hearing as prescribed by section
18-1.501.5 of the City's Municipal Code, may approve a
tentative parcel map consolidating r-ot more than four lots of
record into a single parcel. the lots consolidation may
include remainders and ren¢~artts of lots and lots created by
deed urrier prior law.
le-1.503.1 Form and Content of MaQg
The form and ooartent of the parcel map shall be governed by
Sectiaris 18-1.402 - 18.1.402.5 of the Municipal Code.
18-1.503.2 CorKLitiorLs of Approval
In approving such parcel map, the Director of Planning and
Development may irtg~ose reasonable oorriitions which have been
imposed upon subdivisions irnrolvirg similarly situated
parcels or when said conditions implement general plan policy
ar p2~eviously iagrosed conditions of approval for a zoning
ar use permit approval irrvolvirxg the affected property.
18-1.503.5 Rewrdation of Mao
Upon approval, the parcel map. with aooa~anying agreements,
shall be filed with the County Recorder.
18-x.503.3 Anneal
Any person may appeal to the City Council approval ar denial
of a parcel map. sought .under these provisions in the same
mariner as appeals processed order section 18-1.501.8.2 et.
seq. of this Municipal Code.
z. Severability
If any section, subsection, sentence, clause, phrase, or
portiar of this Ozdirmnce is for any' reason held to be
irwalid or unconstitutional by the decision of any Oourt of
cat~etertt jurisdiction, such decision shall not affect the
remaining portions of this Oxdinatsoe. The City Council of
this city hereby declares that it would have adapted this
Ordinance and each section, subsection, sentence, clause,
phrase or portion thereof, irrespective of any such said
decisicn.
3. Statement of Urgeix,
This Council hereby finds, determines, and declares that this
Oxdinanoe is an urgency measure necessary far the immediate
presetvatian of the public peace, health, and safety and
shall go into effect irim~ediately upon adoption. The facts
ocnstituti,rrg such urgency are:
The section of the State subdivision map art oonoerr~iryg
voluntary mezgera was omitted fmn a recent State Map
Amerrhnent. The inability to consolidate lots via the
voluntary meager process has created a hazdship for several
ir,atvidtrals currently seeking building permit review.
