WHFT~EAS, te~oraiy political signs are a traditional part of political
life befame an election. Ficwever, after the election is over, tejtg~oraiy
political signs pease to perform their intended fiction, create a health
arxi safety problem and enocxirage blight within the City of Cupertino.
WF~AS, the public health, safety atxi welfare of the citizens of
Cupertim may be endangered by the presence oP abandoned temporary
political signs; and
WHERF'AS, it is necessary for the protection of all citizens that the
posting and reiooval oP tempozary political signs be regulated.
NOW, , BE IT ORDAINID, that tha City of GUpertino hereby acts
as Follows:
Section 1 - AmencLnent•
~e City hereby amends section 17.08.280 of Q:apter 17.08, Section
17.16.010(fj of Ctsapter 17.16, anxi Section 17.32.120 of Gfiapter 17.32, to
read as follows:
17.08.280 - Termoraiv Fblitical Siq~.
"Tempozary Political Sign" means a sign which encourages particular
vote in a scheduled electicm and is posted prior to the scheduled
election.

fmn the permit requirements of C2:apter 17.12 of this title.

The City hereby repeals Section Ntmber 17,32.040 oP Clwpter 17.32, of
Title 17 of the Cupertino 1~IIuiicipal Code, and hereby replaces it with this
Ordinance No. 1320.
17.32.040 - Ta®orarv iblitical Siars:
(a) Public riot-of-way. R~ozaty political signs stall be
permitted in all zones of the City including public rights-of~way within
the City of A~pertino.
(b) Duration arxi Removal. A te~orary political signs may be erected
not more than 9o days prior to the day of the election to which it relates
and shall be oouQleted rat-nved not later than 10 days after the date of
such election. Notwithstardinq the pr+eced.ing time provisions, if the
Planning Director finds that any te~ozazy political sign otherwise
permitted is an immediate peril ar menace to pedestrian or vehicular
traffic, ar to the health ar safety oP any person, s/he shall cause it to
be sumaarily removed.
(c) boemptim. Temporary political signs are eft fmm the permit
r~ of Chapter 17.12 oP this Title.
(d) Violation. Any anti all tenparary political signs not removed in
aooordanoe with this Section shall be governed by tha provisions of
Chapter 17.48, 17.52, and 17.56 of this Title.
Section 3. Publication
The City Clerk shall cause this ardinanoa to be published at least
once in a newspaper of general circulation published and circulated in the
City within fifteen (15) days after its passage, in aooordanoe with
Section 36933 oP the Goverlmient Code; shall oertiPy to the adoption oP
this ordinanos std shall cause this ordinartoe std her certification,
together with proo! oP publication, to be entered in the Book of
Ordinances of the Council of this City.
