AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING CHAPTER 16.16
OF THE CUPERTINO MUNICIPAL CODE BY ADOPTING 'fNE "NATIONAL
ELECTRICAL CODE", 1984 EDITION, AND THE UNIFORM
ADMINISTRATIVE CODE PROVISION5 FOR THE
NATIONAL ELECTRICAL CODE, 1484 EDITION.
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS
FOLLOWS:
Chapter 16.16 of the Cupertino Municipal Code is hereby
amended to read as follows:
Section 16.16.010. Adoptign of _1984 Natfonal_El~ctr~cal_Cgde
The provisions of said National Electrical Code and each
and all of the regulations, provisions, conditions and terms of
said code (three copies of which have been filed for use and
examination by the public in the Office of the City Clerk) and
hereby referred to and hereby edopted, the same as if fully eet
forth in this Ordinance, and are by such reference adopted and
sections of this Ordinance.
Section 16.16.020. Qrticle_100 Amended=_Definitions
Article 100 is hereby amended by adding thereto the
following:
• A. Electrical CorUtract4r9: For the purpose of this
article, an Electrical Contractor shall be a person
holding a valid electrical contractor's license
issued by the State of California.
B. Jgurneyman_Electrigian: No person shall act in the
capacity of Journeyman Electrician, as herein
defined, without a journeyman electrician's
certificate of competency, issued by the Electrical
Hoard of Examiners, as provided in this section.
C. MaiOterUance__~legtrician is an electrician qualified
by training and experience to do the recurring work
required to keep a facility in such condition that
it may be utilized at its designated capacity and
efficiency, to do repair work by replacement or
overhaul of constituent parts or materials to keep
or restore a facility to a condition substantially
equivalent to its original or design capacity or
efficiency.

A. The language used in this Code, and the National Electrical
Code, which are made a part of this Code by reference, is
intended to convey the common and accepted meaning familiar
to the electrical industry.
8. The Building Official or his assistants is hereby authorized
to determine the intent and meaning of any provisions of this
Code. Such determination shall 6e made in writing and a
record kept which record shall be open to the public.
Section 16.16.050. Amendments___and__Ad~ition~__to__t~e__1984

A. Article 310 is hereby amended by adding thereto the following
Article 110-23.
1. All materials used in the installation,. alteration or
repair of electrical distribution systems shall be free
from defects and shall be at least of the minimum
approved standards specified for all types of materials
provided in this Ordinance.
Z. Previous used material shall not be reused unless
approved by the Building Official, prior to installation.
3. Certification Letter (no power). On all work where no
power is available, the person or firm doing the work
shall complete and sign a certification statement for
test at time of final electrical. See Exhibit "A".
4. Electrical work shall be done only by:
a. Owner/occupant.
b. Electrical contractors who are in compliance with the
State licensing laws.
c. General Building Contractor with current B-1 license
in conjunction with building permit only.
d. Maintenance Electrician.

5. Ali elec~cal wiring shall be i~alled in approved
raceway for all buildings and structures, other than R1,
R3, and M occupancies.
• 6. A11 transformers shall be installed in an open, readily
accessible and visible area except signaling and ballast
type transformers.
7. All switches shall be located a minimum of 5 ft. from
nearest edge of tub or shower measured horizontally or
install an approved G.F.I.
Section 16.16.060. Electrical MaiRtenagce_PCogram
Any person regularly employing one or more full-time
qualified electricians for the purpose of installation,
alteration, maintenance or repair on any property which Such
person owns or occupies, may designate a qualified electrician as
a Maintenance Electrician. Upon being approved by the Chief
Building Official, the Maintenance Electrician shall make monthly
or quarterly reports to the City covering all installations,
additions, or alterations. All such work shall be installed and
done in accordance with the provisions of the Electrical Code,
and shall be subject to the payment of fees, and to inspection by
the electrical inspector to the same extent as similar work
performed by other persons and for which such inspection is
provided.

Any person, firm, corporation, partnership or
co-partnership who willfully violates any of the provisions, or
fails to comply with .any of the mandatory requirements of this
Ordinance is guilty of an infraction, and ups conviction
thereof, shall be punishable as provided in Chapter 1.12 of the
Cupertino Municipal Code, except that nothing herein contained
shall be deemed to bar any legal, equitable, or summary remedy to
which the City of Cupertino or other political subdivision, or
any person, firm, corporation or partnership may be otherwise
entitled and the City of Cupertino or any other political
subdivision or person, firm, corporation ar partnership may file
a suit in the Superior Court of the County of Santa Clara, to
restrain, or enjoin any attempted or proposed subdivision, or
acts, in violation of this Chapter.

1. Grounding conductor continuity.
2. Correct wiring polarity.
3. Overcurrent devices.
4. Appliances and special equipment.
5. G.F.I. circuits.
The test required above shall be recorded and shall 6e made
• available on request from the Building Department. The recorded
test shall be signed and dated by the testor.
