Ordinance 1310• ORDINANCE NO. 1~1Q__ • AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING CHAPTER 16.20 OF THE CUPERTINO MUNICIPAL CODE BY ADOPTING THE "UNIFO~~'i • P~U~IQINQ_CQQE", APPENDICES A THROUGH I, IAPMO INSTALLATION STANDARD8 AND 1984 ACCUMULATIVE SUPPLEMENT TO THE ICBO PLUMBING CODE 1982 EDITION AND APPROPRIATE EXCEPTIONS THERETO THE CITY COUNCIL DF THE CITY OF CUPERTINO .DOES ORDAIN AS FOLLOWS: Chapter 16.20 of the Cupertino Municipal Code is hereby amended to read as follows: Section 16.20.010. Agopted by_RefeC,~OEe That certain code entitled "International Association of Plumbing Officials Uniform Plumbing Code". 1982 Edition, hereinafter referred to in this Ordinance as the "Uniform Plumbing Code, 1982 Edition", three (3) copies of which are on file in the office of the City Clerk for use and examination by the public, excepting those provisions hereinafter noted is hereby adopted by reference. Section 16.20.020. ~lame_IOser~~gr1 • The names "Cupertino" and "California" shall be inserted in the appropriate places provided therefore fn each and every section of said Uniform Plumbing Code, 1982 Edition, wherein either the name of the City or State is left blank. Board_gf AeHeals Section 20.14 of the Uniform Plumbing Code is hereby amended to read as follows: In order to determine the suitability of alternate materials and methods of construction and to provide for reasonatrle interpretations of the provisions of this Code, there shall be and is hereby created a Board of Appeals, consisting of five members who are qualified by experience and training to pass upon matters • pertaining to building construction installation and materials. The Building Official shall be an ex-officio member and shall act as Secretary of the Hoard. The Board of Appeals shall be appointed by the Hayor, subject to the approval of the City Council, and shall -"'- • hula{ office at hi • lea=_ure. The Hoard sha2~adopt reasonable rules .and regulations 4er conducting its investigations and shall render all decisions and findings in writing to the Building Official with a duplicate copy to the appellant, and may recommend to thc~ City Council such new legislation as is consistent therewith. The' same personnel of the Hoard of Appeals appointed under this Code may act a~ the Hoard of Appeals under the other building construction uniform codes. In the event an Appeals Board is not appointed by they legislative body, the Council shall serve as said Appeals Hoard. Section 16.20.040. Hearing This Ordinance shalt, after first reading, be scheduled for public hearing as provided in Section 50022.3 of the Government Coc1e. Notice of hearing shall be published pursuant to Section 6066 of khe Government Code in the Cupertino Courier. Copies of the Uniform Code and this Ordinance shall be on file with the City Clerk and open for public inspection. Municieal_Code Adopts this code by reference. Section 16.20.020. ~igniciQal_~ode Required for insertion of City of Cupertino and State of California in appropriate places. Section 16.20.030. ~lunicigal Cg~e Clarifies incorporation of Code Section Numbers and Ordinance Numbers will be the same. ~ Section 20.3. Uniform Plumbing_Cgde The addition of this .wording was necessary. The. penalty language would be the same for all the Ordinances. Section 20.7. Uniform P},umbir~g_Code Revises fee schedule comparable to surrounding jurisdictions. Section 20.14. UnifgCm_Qlumbing_~g~e • Clarifies who will sit on the Appeals Hoard. -4- •
