ORDINANCE N0. 1307
AN ORDINANCE OF THE CITY OF CUPEATINO AMENDING
SECTION 1 OF ORDINANCE N0. 2 HY REZONING
APPROXIMATELY TWO AGRES FROM ML ZONE TOP ZONE;
LOCATED ON THE NORTHWEST CORNER OF HIGHNAY 280
AND DE ANZA BOULEVARD
WHEREAS, on March 25, 1985, an application was filed by De Anza
Properties (Otis Forge) for .the rezoning of property from ML (light
Industrial) zone to P (Planned Development xith Commercial intent) zone;
and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted;
and
WHEREAS, the. property to be rezoned is presently in an ML (Light
Industrial) zone; and
WHEREAS, a map of the aub~ect property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of
Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. .That the property described in attached Exhibit "A" be and
hereby is rezoned to a P (Planned Development with Commercial intent)
zone, sub~eot to conditions listed in attached Exhibit "C"; and that
Exhibit "H" attached hereto is made part of the Master Zoning Map of the
City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this 3rd day of June ^, 1985 and ENACTED at a regular
meeting of the City Council of the City oP Cupertino this 17th day

CONDITIONS:
1-15. STANDARD CONDITIONS
Standard Conditions to the extent. that they do not conflict with
the special conditions enumerated herein. in the. event a
conflict does exist, the special conditions as enumerated herein
shall apply.
16. APPROVED EXHIBITS
That the reoo~endation of approval is based on Exhibit A of
Application 7-Z-85 except as may be amended by special conditions
enumerated herein.
17. PERMITTED USES
That Planned Developmont commercial zone may include general,
corporate, or administrative office uses, and/or commercial uses
including a hotel or motel. Manufacturing uses shall be
apeeifieally prohibited unless conducted as proto-type research
and development activity in concert with office functions or
business establishments. Proto-type R & D activities shall be
regulated in accordance with guidelines specified in the
Cupertino General Plan. All new uses or changes in the use Prom
those approved herein shall require a use permit reviex as
determined by the Director of Planning and Development.
LAND DEDICATION
The applicant shall. dedicate land sufficient to acnommodate an
additional southbound lane on De Anza Boulevard equalling
approximately 10 ft. 1n width an shall complete the street
improvements to standards of the City of Cupertino. The plan
shall accommodate a minimum 10 ft. parkway planted with lawn
similar to the treatment along North De Anza Boulevard and
Stevens Creek Boulevard.
