ORDINANCE N0. 1299
AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING
SECTION 1 OF ORDINANCE NO. 2 BY REZONING
APPROXIMATELY 1.T GROSS ACRES FROM CO ZONE TO P
ZONE; LOCATED ON THE WEST SIDE OF DE ANZA BOULEVARD
APPROXIMATELY 450 FT. SOUTH OF MCCLELLAN ROAD
WHEREAS, on January 14, 1985, an application was Piled by Dr. Kenneth
Frangadakis (De Anza Professional Center) (Applieatlon 3-Z-85) for the.
rezoning of property from CG (General Commeroial) zone to P (Planned.
Development with commercial and office use intent) zone; and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Counoil that the Rezoning be granted;
and
WHEREAS, the property to be rezoned is presently in a CG (General
Commercial) zone; and
WHEREAS, a map of the su6~eot property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of
Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWSs
Section 1. That the property described in attached Exhibit "A" be and
hereby is rezoned to a P (Planned Development with commeroial and office
use intent) zone, subject to conditions listed in attached Exhibit "C";
and that Exhibit "B" attached hereto is made part of the Master Zoning Map
of tha City of Cupertino.
Section 2. Thie ordinance shall take effeot and be in force thirty
(30) days after its passage.

meeting of the City Council of the City of Cupertino this lAth day

CONDITIONSt
1-15. STANDARD CONDITIONS
Standard Conditions to the extent that they do not oonfliot with
the speoial. gonditions enumerated herein. In the event a
conPliot does exist, the speoial oonditiona as enumerated herein
shall apply.
16. APPROVED EXHIBITS
That the recommendation of approval is based on Exhibit A of
Application 3-Z-85 except as may be amended by speoial conditions
enumerated herein.
17. USE LIMITATIONS
If the property's Floor Area Ratio does not exceed .25, permitted
uses shall include all uses allowed without the securing of a use
peraoit in the City of Cupertino CG (General Commera1a11 zoning
district. If the property`s Floor Area Ratio is between .25 and
.33, permitted uses shall inolude all uses allowed without the
securing of a use permit in the City's OP (Planned Office) zoning
district'. All uses requiring use permit review in a CC or OP
zone shall require use permit review in the sub,jeat Planned
Development zone.
18. PUBLIC IMPROVEMENTS
The applioant shall be required to dedicate additional right of
way along De Anza Boulevard and relocate the existing public
improvements per the approval oP the Direotor of Pub11o Works.
