Ordinance 1277 ORDINANCE NO. 1277 AN ORDINANCE OF THE CITY OF CUPERTINO REPEALING CERTAIN ORDINANCES OUTLINED IN SECTION 2 AND ESTABLISHING AN ORDINANCE REGULATING PARKING SECTION_1___REsPEA~ING_CLAUS~S Section_1L1_ Ordinance No. OO2fq), as amended by Ordinance No. 372 and O02(q-1) of the City of Cupertino, California, is hereby repealed. All other ordinances heretofore enacted in conflict with this Ordinance No. 1277 .are hereby repealed to the extent that they vary from the provisions of this Ordinance. SECTION_2___PURPUSE S~ction__2_1: The purpose of this Ordinance is to establish regulations pertaining to the design and number of off-street parking spaces for land use activities located in various zoning districts. SECTIOt~_3___APe~ICQTION Sectio0__3:1_ Building, structures, and land uses are required to provide off-street parking in conformance with the provisions of this Ordinance. Section 3 2: Existing buildings, structures and land uses which are lawfully in er.istence at the time this Ordinance became effective may remain as long as no alterations take place except those permitted by Santa Clara County Ordinance No. NS-1200, Section 30, as it existed on October 10, 1965, which was adopted by the City of Cupertino. Section 3_3: The standards and regulations contained in this Ordinance regulate off-street parking for conventional zoning districts. The standards and regulations function as guidelines for development projects located in a Planned Development zone. SECTION 4: DEFINITIONS 5ectiQn_4~1: Garagg_ A completely enclosed building or part of building intended and designed to accommodate one or more motor vehicles. 1 • ORDINANCE NO. 127• tCONTiNUED) • Section_4_2:__Car_Shelter_ A roofed structure of apart of a building not enclosed by walls, intended and. designed to accommodate one or more motor vehicles. S_ec_t_ion 4.3:______Par~ing__Area_ An unroofed paved area delineated by painted or similar markings, intended and designed to accommodate one or more vehicles. S~gtion 4_4: _Seace_ The area required to garage or park one motor vehicle. Where this Ordinance requires a space, without specifying garage, carport, car shelter, or parking space, it shall mean an unroofed paved area with individual .parking stalls delineated by paint or similar marking material. SECTION_5___PA~KING_REQUIR~~~NTS Section__5:i____Parking_Ratio_and_Dimensions_ Table 1 defines the required number of parking spaces by size and type for specific zoning districts and uses within zoning districts. Secision_ 5_2___Aisle_Dimensions_ Aisle dimensions shall be as required by "Standard Details", adopted by the City Engineer. S__ec_ttion 5.3:____Loading__Area_ Loading area, truck parking spaces, and parking spaces for vehicles other than passenger cars shall have ample dimensions for the particular use and type of operation, and be designed as required by the .City Engineer. Section 5_4_____Parking Exception_ The City Council may grant a parking exception for a project not located in a Planned Development zoning district. The rationale for an exception shall be er.traordinary conditions not generally applying to similar uses, such as an instance where an unusually high percentage of the lot area is landscaped. Application for an Exception shall be made in writing to the Planning Commission. Hearings before the Planning Commission and the City Council shall be conducted as set f orth for Variances in Ordinance No. 002(a), Revised, of the City of Cupertino, except that the hearings shall not be required to be published as public hearings. Section_ S_5_____Planned__Dev_eloement__pistrigts_ The parking requirements contained in Table i function as guidelines for projects in Planned Development zoning districts. The Architectural and Site Approval Committee, Planning Commission, and/or City Council may approve a development plan which deviates from Table 1 requirements if an applicant provides a parking study which supports said deviations>. ORDINANCE NO. 1277 (CONTINUED) Section 5.6:____Staff_Rev_iew_of Mi:<ed Use Proiects_ When more ------------ ------------ than one of the activities specified in Table 1 of this Ordinance is initiated in a building or on a site not requiring review by elected or appointed officials, the Director of Planning and Development shall determine the total parking requirement based upon the application of parking requirements for individual uses as described in Table 1. S_ec_t_io_n___5_.7_:____Shared_P_a_r_I:in_g_ The Planning Commission and City Council may approve a shared parking concept whereby a parking space is utilized to serve two or more individual land uses. The approval must meet the following conditions: a> The land use consists of a shopping center, office, or industrial development which is .owned or managed by a single entity. b) The lane} uses under single management are in close proximity to each other and are served by a common parking facility. c) The applicant submitted a detailed parking study which demonstrates that the proposed mix of uses is compatible with the proposed parking supply. The proposed shared parking plan may be approved by the ASAC. Planning Commission, and City Council in the context of a public hearing for a use permit in a Planned Development zone or via a public hearing for an exception for a project which is not located in a Planned Development zone. ' Section 5.8: ____Tandems__Valet,,_ Other__Sgecial__Parking ------------------ Arrangements_ Tandem, valet, validated and other special forms of parking may be approved by the Planning Commission and the City Council in the conte:;t of a public hearing for a use permit in a Planned Development zone or via a public hearing for an exception in the. case of a project which is not located in a Planned Development zone. Section 5.9: Minimum Stall Dimension in Par king_Structures_ ------------------------------------------------- The minimum stall dimensions for a standard space, located in a parking garage or enclosed parking structure and intended for rton-residential uses is B'B" x 18'. The minimum dimensions for a similarity situated compact space is 8' x 15'b". Section 5_10___~-IandigagQed_Parking_ The handicapped parY.ing requirement embodied in Section 7.7102 of Title 24 of the State of California Administrative Code, as amended, shall be adhered to and is hereby incorporated into the Ordinance by reference. ORDINANCE NO. 127 (CONTINUED) • SECTION_b___S~VERAbILITY_CL~USE Section_6_1: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The legislative body hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. SECTION 7___PUBLIS~IIN~i_~LAUSE Section__7_1_ The. City Clerk is hereby authorized and directed to cause a certified copy' of this Ordinance to be published at least once within fifteen f15) days after its enactment in the Cupertino Courier, the official newspaper of the City, published and circulated in the City of Cupertino.
