AN ORDINANCE OF T}H: CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0.2 BY REZONING APPROXIMATELY 30 ACRES
FROM R1-6 20NE TO R1-61 ZONE; THE REZONING PROPOSES TO
ADD THE "i" DESIGNATION WIIICH WILL IMPOSE A BUILDING
HEIGHT RESTRICTION OF ONE-STORY NOT TO EXCEED 15 FT.
UPON ALL NEW CONSTRUCTION WITHIN T}}E ZONING BOUNDARY;
THE SUBJECT PROPERTY CONSISTS OF THE LAURELHURST SUB-
DIVISION, TRACT NUM$ERS 1939, 2320, 2483 AND 2539 WHICH
ARE LOCATED ON THE FOLLOWING STREETS: HEATNERWOOD
DRIVE. COLONY HILLS LANE, FALLENLEAF LANE, TIPTOE LANE
AND WESTLYN WAY, GENERALLY BORDERED AS FOLLOWS: BEGIN-
NING APPROXIMATELY 350 FT. WEST OF SARATOGA-SUNNYVALE
ROAD AT THE INTERSECTION WITH FALLENLEAF LANE, 200 FT.
NORTHEAST OF THE UNIAD?ROYED HIGHWAY 85 RIGHT OF WAY, 600
FT. EAST OF STEELING ROAD AND 1,000 FT. SOUTH OF BOL-
LINGER ROAD (ADJACENT TO AND 50UT}iERLY OF JOLLYA}AN

THE CITY COUNCIL OF TILE CITY OF CUPERTLNO DOES ORDAIN AS FOLLOWS:
WI}EREA5, on November 8, 1982, an application was filed by City of
Cupertino (Laurelhurst Subdivision) (Application 15-Z-82) for the rezoning
of property from R1-6 (Residential Single-family, b,000 aq. ft. minimum
lot size) zone to R1-61 (Residential Single-family, 6,000 aq. ft. minimum
lot size zone, single-story maximum height) zone, and
W}iEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted,
and
WHEREAS, the property to be rezoned is presently in an R1-6 (Residential
Single-family, 6,000 sq. ft. minimum lot size) zone; and
WIH:REAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cuper-
tino.
NOW, THEREFORE, BE IT ORDAINED AS FOLIAWS:
Section 1. Tiwt the property described in attached Exhibit "A" be
and hereby is rezoned to a R1-6i (Residential Single-Family, 6,000 sq.
ft. minimum lot size zone, single-story maximum height) zone; and that
Exhibit "B" attached hereto is made part of the Master Zoning Map of the
City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty
(30) days after its passage.
