Ordinance 1211 ORDINANCE N0. 1211 AN .ORDINANCE OF THE CITY OF CUPERTINO AMENDING CHAPTER 11.30 'OF THE CUPERTINO MUNICIPAL CODE TO DELETE THE FORMER CRUISING ORDINANCE AND SUBSTITUTE AN ORDINANCE SPECIFICALLY ALLOWED BY SECTION 21100(k) OF THE CALIFORNIA VEHICLE CODE The City Council of the City of Cupertino hereby ordains as follows: SECTION 1. Chapter 11.30 of the City of Cupertino Municipal Code is hereby amended to read as follows: Chapter 11.30 REGULATION OF TRAFFIC IN THE DOWNTOWN AREA Sections• 11.30.010 Definitions 11.30.020 Exclusions 11.30.030 Prohibitions 11.30,040 Violation--Penalty 11.30.010 Definitions. The following definitions apply to this chapter: A. "Central business district" means Stevens Creek Boulevard bounded by Tantau Avenue. to Lhe east and Peninsula Avenue/Bubb Road to the west; Wolfe Road bounded by Calle De Barcelona to the south and Homestead Road to the north; and De Anza Boulevard bounded by Bollinger Road to the south and Homestead Road to the north. 1 B. "Cruising" is driving a motor vehicle on a highway past a traffic control point designated by a peace officer, under conditions in which traffic is congested at or near the control point, three or more times within a two-hour period, after having driven past said control point twice within the same period and having been given adequate written notice after the second passing that passing the control point a third time under the conditions stated herein shall constitute a violation of this section. C. "Highway" and "motor vehicle" are defined in Sections 360 and 415 respectively, of the Vehicle Code. 11.30.020 Exclusions. This article shall not apply to the following vehicles: emergency vehicles on patrol, taxicabs for hire, and other business vehicles being driven for business purposes. 11.30.030 Prohibitions. Cruising is prohibited in the "central business district". 11.30.040 Violation--Penalty. Any person who violates any of the provisions of this chapter shall be guilty of an infraction and upon conviction thereof shall be punished as provided in Chapter 1.12. SECTION 2. This ordinance takes effect thirty (30) days after the date it is adopted.
