AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY PREZONING APPROXIMATELY .IS GROSS
ACRE FROM SANTA CLARA COUNTY R1-8 ZONE TO CITY OF CUPER-
TINO R1-7.5 ZONE, LOCATED ON THE EAST SIDE OF BYRNE
AVENUE APPROXIMATELY 66 FT. NORTH OF LOMITA AVENUE AND
156 FT. SOUTH OF HERMOSA AVENUE (10168 BYRNE AVENUE)
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WfiEREAS, on July 9. 1982, an application was filed by Gary and
Sally Conner (Application 10-Z-82) for the prezoning of property from
Santa Clara County R1-8 (Residentlal Singly..-family, 8,000 aq. ft. minimum
lot size) zone tv City of Cupertino R1-7.5 (Residential Single-family,
1,500 sq. ft. minimum lot size) zone, and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the prezoning be granted,
and
WHEREAS, the property [o be prezoned is presently in a Santa Clara
County R1-8 (Residential Single-family, 8,000 aq. ft, minimum lot size)
zone; and
WHEREAS, a map of the aub~ect property is attached hereto as
Exhibit "A" as a proposed amendment to the Master Zoning Map of the
City of Cupectino;
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the following described property be and hereby
is prezoned to a City of Cupertino R1-7.5 (Residential Single-family,
7,500 sq. ft. minimum lot size) zone; and that Exhibit "$" attached
hereto is made-part of the Master Zoning Map of the City ofCupertnlo.
Section 1. This ordinance shall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City
of Cupertino this 7th day of September, 1982 and ENACTED at a
regular meeting of the City Council of the City of Cupertino this 20th.

All that certain parcel of land situate in the County of Santa Clara,
State of California, described as follows:
The South 34.12 feet of Section 69, and the North 32.0 feet of Section
70, by a uniform depth of 120.15 feet (measured from the original center
line of Byrne Avenue formerly Buena Vista Avenue, as the same originally
existed 40 feet wlde), as shown on the Map entiteld, "Map of Subdivision
"A" Monts Vista", which Map was filed for record in the office of the
Recorder of the County of Santa Clara, State of California on April 11,
1917 in Book of Maps letters "P" at page 20.
