ORDINANCE N0. 1169
AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY REZONING APPROXIMATELY 7.3 CROSS
ACRES FROM A TO P ZONE; LOCATED ON THE SOUTHWESTERLY
i_- "' QUADRANT OF HOMESTEAD ROAD AND DE ANZA BOULEVARD JUST
NORTH OF HIGHWAY 280 (BEHIND HOMESTEAD SQUARE SHOPPING
CENTER AND DE ANZA LllMBER)
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on January 4, 1982, an application was filed by De Anza
Forge (Cupertino Viliage) (Application 19-Z-81) for the rezoning of
property from A (Exclusive Agriculture) to P (Planned Development with
residential 10-20 dwelling units per gross acre and mini-storage intent)
zone; and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted; and
WHEREAS, the property to be rezoned is presently in an A (Exclusive
Agriclture) zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cuper-
tino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That .the property described in attached Exhibit "A"
be and hereby is rezoned to a P (Planned Development with residential
10-20 dwelling unite per gross acre and mini-storage in tent). zone, subject
to conditions listed in attached Exhibit "C"; and that Exhibit "B"
attached hereto is made part of the Master Zoning Map of the City of
Cupertino.
Section 2. This ordinance shall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this .9th day of March 1982 and ENACTED at a regular
meeting of the City Council of the City of Cupertino this 5th day of
April 1982 by the following vote:

BEGINNING at the Northwest corner of that certain 2.00 Acre
parcel as shown on that certain Record of Survey filed for record
in Book 152 of Maps at Page 10, Santa Clara County Records;
thence from said POINT OF BEGINNING, along the Westerly line of
said 2.00 Acre parcel S 0° 04' W 307.14 feet to the Southwest
corner of said 2.00 Acre parcel; thence along the Northwesterly
line of that certain 1.155 Acre parcel described in the Final
r Order of Condemnation, recorded July 31, 1963, in Book 6128 of
Official Records at Page 291, Santa Clara County Records
S 73° 09' 49" W 114.00 feet and S 85° 07' 50" W 54.80 feet to the
westerly corner of said 1.155 Acre parcel; thence along the
Southeasterly line of that certain 0.249 Acre parcel of land
conveyed to Otis F. Forge by Deed recorded November 4, 1965, in
Book 7167 of Official Records, at Page 202, Santa Clara County
Records, S 85° 07' S0" W 39.80 feet and S 87° 48' 18• W 701.86
feet to the Southwesterly corner of said 0.249 Acre parcel;
thence along the Westerly line of said 0.249 Acre parcel
N 0° 02' OS" E 27.49 feet to the Northwest corner of said 0.249

CONDITIONS:
- 1-14.-. Stnndard Conditions to the extent that they do not conflict with
the special conditions enumerated herein.. In the event a conflict
does exist, the special conditions enumerated herein shall apply.
15. The approval is based upon Exhibit A 1st Revision of Application
19-Z-S1 as may be amended by additional conditions contained
herein.
16. The mini-storage component shall not exceed 33X of .land area
and shall be constructed in conjunction with construction of at
least .two (2) residential buildings for a total of 16 units. The
entire site shall be rough graded.
