AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
• OF ORDINANCE N0. 2 BY REZONING APPROXIMATELY 505'GROSS
ACRES FROM Al-43 ZONE AND PRE20NING APPROXIMATELY 12
GROSS ACRES FROM SANTA CLARA COUNTY Al-lac ZONE TO CITY
OF CUPERTINO RHS ZONE; CONSISTS OF UNDEVELOPED HILLSIDE
AREAS LOCATED SOUTHEASTERLY OF THE KAISER PERMANENTE
CEMENT PLANT LOCATED ON STEVENS CREEK BOULEVARD (PERMA-
NENTS ROAD) AND NORTHWESTERLY OF STEVENS CANYON ROAD BE-
GINNING APPROXIMATELY 3,800 FT. (2/3 MILE) NORTH OF
MONTEBELLO ROAD
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on July 13, 1981, an application was filed by the City of
Cupertino (Kaiser Property) (Application 17-Z-S1) for the rezoning and
prezoning of property from Al-43 (Agricultural Residential, 43,000 sq. ft.
minimum lot size) zone and Santa Clara County Al-lac (Residential Hillside
Slope Density Formula) to City of Cupertino RHS (Residential Hillside
Slope Density Formula) zone; and
WHEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Rezoning and Prezoning be
granted; and
WHEREAS, the property to be rezoned is presently in an Al-43 (Agricul-
tural Residential, 43,000 sq. ft, minimum lot size) zone and the property
to be pre zoned is presently in a Santa Clara County Al-lac (Agricultural and
Residential 1 acre minimum lot size) zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit.
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW,. THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be
and hereby is rezoned and prezoned to City of Cupertino RHS (Residential
Hillside Slope Density Formula) zone; and that Exhibit "B" attached hereto
is made part of the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty
(30) days after its passage.
