Ordinance 1136• ORDINANCE N0. 1.136 • AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 6,4 OF ORDINANCE NO. 652 PERTAINING TO PROCEDllRES IN THE DUITTERS OF A.'~fEND1I:G THE GENERAL PT.AN, AMENDING THE ZONING ORDINANCE, AMENDING THE OFFICIAL, ZONING MAP> FROCEDURES IN THE MATTER OF CONDITIONAL USE PERMITS AND VARIANCES THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS: SECTION 1: AMENDMENT Section 1.1: Ordinance No. 652 is hereby amended ae set forth in this ordinance No. 1136. SECTION 2: REPEALING CLAUSE Section 2.1: Section 6.4 of Ordinance No. 652 is hereby repealed and re-enacted as follows: Section 6.4: Expiration: In any case where a conditional use permit has not been used within a twenty-four (24) month period after date of granting thereof (or within such other period of time which may be prescribed in pezmit or within any extension Rranted pursuant to this section), then, without further action, the permit shall automatically expire. A permit shall be deemed to have been "used" when actual, substantial and continuous activity has taken place upon the land pursuant to the permit or, in the event of the erection of a structure or structures, when sufficient building activity has occurred and continues to occur in a diligent manner. Prior to the automatic expiration, the Planning Commission may review a request by tiie applicant for an extension of time to initiate said use permit. The Commission shall have the authority to extend the time limit as a condition in the issuance of the conditional use permit.
