MUNICIPAL CODE REQUIRINC A PRELIMINARY SOIL REPORT AND APPROVAL THEREOF AS A
CONDITION TO THE ISSUANCE OF A BUILDING PERMIT OR FINAL APPROVAL OF A SUB-
DIVISION MAP
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
Chapter 16.12 Soil Report Requirements.
This ordinance is enacted pursuant to the provisions of Sections 16953
through 17957 of the Health and Safety Code of the State of California, re
lating to housing, and reaffirms the requirement of an approved preliminary
soil report as a condition to the issuance of a building permit, (Ordinance
409, Section 1968).
Section 2: Requirement.
A preliminary soil report shall be required of every subdivision as de-
fined in Sections 11535 and 1135.1 of the Business and Professions Code; except,
t}iat, due to the knowledge of the City of Cupertino Engineering Department has as
to the sail qualities of the soil of the subdivision or lot, no preliminary analysis
is necessary.
The City Engineer shall however, have the right in individual single family
residential consturction only, to limit the soils report to a letter of review.
Said letter shall consist of a statement that in the opinion of the soils engineer,
the Provisions of U.B.C. apply without modification or special work being involved.
Said letter shall also address any other request by the City Engineer.
Section 3: Preliminary Soils Report Requirements.
The report shall be comprehensive and shall include an analysis of:
A. Stability of all slopes, within the lot (subdivision) or slopes above,
below or adjacent to the area under investigation.
B. The classification of all soils for expansion potential.
C. The classification of the soils according to the Unified Soils Classific.ition
System.
D. The establishment of design bearing values and anticipated maximum settlementti.
E. Soil profiles including revelant data to depths which reflect the nature
and magnitude of the future loading.

Section ~i: Prcpnrntion_
The preliminary soil report shall be. prepared by a civil engineer who
~ is registered by the Stale of California and shall he based upon adequate
test borings, excavations, or in the case of the letter of review, field
observations.
Section 5: Approval of Report
The preliminary soil report shall be filed with and approved by the
City Engineer.
Section 6: Conditions for Building Permit
No building permit shall be issued for the construction of any structure
on any lot or subdivision subject to this ordinance unless or until an approved
preliminary soil report has been filed first with the City Engineer; nr said
report has been waived pursuant to the provisions of this ordinance or, the
corrective action, if any, has Been assured.
Section 7: Appeals
Appeals from determinations made under this ordinance may be made to the
City Council by the filing of a written request with the City Clerk within
five days of such determination having communicated to the applicant for the
building permit.
