ORDINANCE N0. 1110
AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY REZONING APPROXIMATELY 8 GROSS
ACRES FROii P TO P; LOCATED ON THE NORTN SIDE OF ROD-
RIGUES AVENUE FROM DE ANZA BOULEVARD TO A POINT APPROXI-
MATELY 400 FT. WESTERLY OF TORRE AVENUE
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WiiEREAS, on March 6, 1981, an application was filed by Lincoln Property
Company N.C., Inc. (Application 4-Z-81) for the rezoning of property from
P (Planned Development) to P (Planned Development with Commercial Office,
and Residential, Maximum 30 Dwelling Unlts Per Gross Acre Intent) zone;
and
WHEREAS, upon due notice and after one public hearing the Planning
Commission recommended to the City Council that the Rezoning be granted;
and
l.'HEREAS, the property to be rezoned is presently in a P (Planned Develop-
ment) Zone; and
Wi{EREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the tlaster Zoning Map of the Ci[y of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:.
Section 1. That the property described in attached Exhibit "A" be and
hereby is rezoned to a P (Planned Development with Commercial Office, and
Residential, Maximum 30 Dwelling Units Per Gross Acre Intent) Zone, subject
to conditions listed in attached Exhibit "C"; ahd that Exhibit "B" attached
hereto is made part of the Master Zoning Hap of the City of Cupertino.
Section Z. This ordinance shall take effect and be in force thirty
(30) days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this 4th day of May 1981 and ENACTED at a regular meeting
of the City Council of the City of Cupertino this 18th day of May 1981
by the following vote:

CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall. apply.
1S. The application is approved based upon the site plan Exhibit A lst
Revision of Application 4-2-81 as may be modified by additional conditions
contained herein.
16. The applicant. or his or her successor in interest shall be required
to participate in road improvements including the construction of
improvements in the intersection of Stevens Creek Boulevard and De
Anza Boulevard. The extent of the improvement shall. be determined
in the future in consort with General Plan traffic studies. The degree
of participation shall be determined based upon a formula which con-
aiders the degree of benefit as determined by recognized assessment
district practices.
