Ordinance 1100• ORDINANCE N0. 1100 AN OfU)INANCE OF Tf1E CITY OF CUPERTINO ADDING CHAPTEI; 2.38 TO THE CUPERTINO MUNICIPAL CODE, ESTABLISHING AN ENERGY COMMISSION THE CITY COUNCIL OF THE CITY OF CUPERTINO ICES HEREBY ORDAIN A5 FOLLOWS: Sections: 2.38.010 Established 2.38.020 Members -- Terms 2.38.030 Members -- Vacancy or Removal 2.38.040 Meetings -- Quorum -- Staff -- Officers 2.38.050 Records 2.38.060 Powers and Functions 2.38.070 Effect 2.38.080 Compensation -- Expenses 2.38.090 Review 2.38.010 Established. The Energy Commission is established. The Energy Commission shall consist of seven members, none of whom shall be officials or employees of the City and the seven members shall be appointed by the City Council. One or more of the seven members must have related energy technology experience. At least five members must be residents of the City. 2.38.020 Members -- Terms. The term of office of the members of the Com- mission shall commence on the effective date of the ordinance, four members to be appointed for the term ending April, 1983, and three members for the term ending April, 1984. Thereafter, the term of office o£ the members of the Commission shall be for four years. 2.38.030 Members -- Vacancy or Removal. Any appointee member may be removed by a majority vote of the City Council. If a vacancy occurs other than by expiration of a term, it shall be filled by the City Council's appointment for the unexpired portion of the term. 2.38.040 Meetings -- Quorum -- Staff -- Officers. The Commission shall elect its chairperson and vice-chairperson from among its members and shall appoint a secretary. Terms of office shall be for one year and shall begin on May 1st and continue through April 30th of the following year. Upon the approval of the City Council on an annual basis, the Commission may appoint a secretary who need not be a member of the Commission. The Energy Commission shall establish a regular place of meeting and rules of conduct thereof, and shall hold at least one regular meeting each month. The Energy Commission shall have available to it such assistance of City staff as may be budgeted to perform its functions,. and staff assignment or administrative support to be under the general direction and supervision of the City ttanager. • A majority of the Energy Commission shall constitute a quorum for the purpose of transacting the business of the Commission. 2.38.050 Records. The Commission shall keep an accurate record of its proceedings and transactions and shall render such reports to the City Council in the form of minutes and shall be submitted promptly after each meeting. 2.38.060 Powers and Functions. The powers and functions of the Energy Commission shall be as follows: A. To hold hearings on matters pertaining to energy conservation matters. 8. To consider, formulate and propose energy conservation programs designed to promote the effective management of energy resources. C. To identify and recommend areas in which the City can improve its own energy consumption levels, and to evaluate the status of .such existing energy projects. D. To gather ail information poaslble on energy technology and de- velopmenta and disseminate to the community and to City staff as appropriate. E. Identify appropriate State legislation that the City Council may wish to support. F. To provide practical input into the formation of an energy element .for [he General Plan. The energy element should include a clear statement of priorities and provide for an on-going review. G.. To investigate State and Federal grants to aid the City in developing energy programs. H. To make in its advisory capacity, any and all recommendations in writing to the City Council relating to the above matters. 2.38.070 Effect. Nothing in this chapter shall be construed as restricting or curtailing any of the powers of the City Council, Planning Commission or City Officers. 2.38.080 Compensation -- Expenses. Members of the Energy Commission shall serve without compensation, but all necessary expenses reasonably incurred by them while acting in their official capacity shall be paid by appropriate action of the City Council. - 2 - 2.38.090. The purpose, effectiveness and necessity of the Energy Commission shall be reviewed on a regular basis every four years.
