THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:

as followas
Section 16.20.010 Adopted by Reference
That certain code entitled "International Association of Plumbing
Officials Uniform Plumbing Code", 1979 Edition, hereinafter referred to in
this Ordinance as the "Uniform Plumbing Code, 1979 Edition", three (3) copies
of which are on file in the office of the City Clerk for use and examination
by the public, excepting those provisions hereinafter noted is hereby adopted
by reference. '
Section 16.20.020 Name Insertion
The names "Cupertino" and "California" shall be inserted in the
appropriate places provided therefore in each and every section of said Uniform
Plumbing Code, 1979 Edition, wherein either the name of the City or State is
left blank.
Section 16.2.0300 Incorporations and Amendments
New sections incorporated into and amendments to the Uniform Plumbing
Code, 1979 Edition (the section numbers hereafter used will correspond to the
numbers in the Unifotm Plumbing Coda, 1979 Edition, or will be inserted in the most
appropriate sections thereof) are as follows:

ADMINISTRATION
Section 20.3 - Violation - Penalty
Any person, firm, corporation, partnership, or co-partnership who
wilfully violates any of the provisions, or fails to comply with any of the
mandatory requirements of this Ordinance is guilty of an infraction, and upon
conviction thereof, shall be punishable as provided in Chapter 1.12 of the
Cupertino Municipal Code, except that nothing herein contained shall be deemed
to bar any legal, equitable, or summary remedy to which the City of Cupertino
or other political subdivision, or any person, firm,. corporation or partner-
ship may be otherwise entitled, and the City of Cupertino or any other political
subdivision, or person, firm, corporation or partnership may file a suit in
the Superior Court of the County of Santa Clara, to restrain, or en~oln any
attempted or proposed subdivision, or acts, in violation of this Chapter.
The issuance or Rranting of a permit or approval of plans and apec-
ificationa shall not be deemed or construed to be a permit for, or an approval
of, any violation of any of the provisions of this code. No permit presuming
to give authority to violate or cancel the provisions of this coda shall be
valid, except insofar as the work or use which is authorized ie lawful.
The issuance or granting of a permit or approval of plena shall
not prevent the Administrative Authority from thereafter requiring the cor-
rection of errors in said plans and specifications or from preventing construction
operations being carried on [hereunder when in violation of this code or of
any other ordinance or from revoking any certificate of approval when issued
in error.
Every permit issued by the Administrative Authority under the pro-
visions of this code shall expire by limitation and become null and void, if
the work authorized by Fuch permit is not commenced within one hundred twenty
(120) days from date of such permit, or if the work authorized by such permit
is suspended or abandoned at any time after the work is commenced for a period
of one hundred twenty (120) days. Beforg such work can be recommenced a new
permit shall be first obtained to do sa,?and the fee therefore eha1L be one-
half the amount required fora new permit for such work, provided no changes
have been made, or will be made in the original plane and apeciflcationa for
such work; and provided, further, that such suspension or abandonment has not
exceeded one (1) year.

Section 20.14 - Board of Appeals
Section 20.14 of the Uniform Plumbing Code is hereby amended to
read as follows:
In order to determine the suitability of alternate materials and
methods of construction and to provide for reasonable interpretations of the
provisions of this Code, there shall be and is hereby created a Board of Appeals,
consisting of five members who are qualified by experience and training to pees
upon matters pertaining to building construction installations and materials.
The Building Official shall be an ex-officio member and shall act as Secretary
of the Board. The Board of Appeals shall be appointed by the lfayor, subject
to Che approval of the City Council, and shall hold office at his pleasure.
The Board shall adopt reasonable rules and regulations for conducting its
investigations and shall render all decisions and findings in writing to the
Auilding Official with a duplicate copy to the appellant, and may recommend
to the City Council such new legislation as is consistent therewith. The same
nersonnel of the Board of Appeals appointed under this Code may act as the
Board of Appeals under the other building construction uniform codes. In the
event an Appeals Board is not appointed by the legislative body, the Council
shall serve as said Appeals Board.
Section 16.20.040 !fearing
This Ordinance shall, after first reading, be scheduled for public
hearing as provided in Section 50022.3 of the Government Code. Notice of hearing
shall be published pursuant to Section b066 of the Government Code in the Cuper-
tino Courier. Copies of the Uniform Code and this Ordinance shall be on file
with the City Clerk and open for public inspection.
