AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING
PARAGRAPH D OF SECTION 2.28.040 OF THE CUPERTINO
MUNICIPAL CODE TO EFFECT A CffANGE IN DEPARTMENTAL
ORGANIZATION
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOIrS:
Paragraph D of Section 2,28.040 is hereby amended to read as .follows:
"Section 2.28.040 Powers and Duties.
D. To appoint, discipline and dismiss any and all oEflcera and
employees of the City except those elected by the electors of the City
or whose appointment or dismissal is denied to the City Manager under
the laws of the state; provided, however, that he shall not have the
power to remove or dismiss a department head until such person has been
notified in writing by the Manager or his intention to remove him at least
fifteen days before the effective date of his removal. I:ithin ten Jaya
after receiving such notice, a department head may request a closed hear-
ing before the City Council, at which hearing he shall have an opportunity
to answer the reasons given for his removal. "Department Head", as used
in this paragraph, includes the Director of Finance, the Director of
Planning and Development, the Director of Public 13orks, the Director of
Parks and Recreation, the City Clerk and such other department heads as
may be established in the future by the City Council. At the hearing,
the City Council can overrule the action of the City Manager only by the
affirmative vote of four members;"
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino this 15th day of September 1980, and ENACTED at a
regular meeting of the City Council of the City of Cupertino this 6th
day of October 1980, by the following vote:
