ORDINANCE N0. 1053 ,
AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE. N0. 2 EY REZONING APPROXIMATELY 3 GROSS
ACRES FROM ML TO P ZONE; LOCATED ON THE SOUTH SIDE OF
HOMESTEAD ROAD APPROXIMATELY 300 FT. EASTERLY OF FOOT-
. HILL EXPRESSWAY (OPPOSITE FALLEN LEAF LANE)
T1tE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on June 6, 1980, an application was filed by Woodepring,
Inc. (Homestead Road) (Application 31-Z-80) for the rezoning of property.
from ML (Light Industrial) to P (Planned Development with medium to high density
residential, 10-20 dwelling unite per gross acre Sntent) zone;' and
WHEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Rezoning be granted; and
WHEREAS, the property to be rezoned is presently in an ML (Light Industrial)
Zone; and
WHEREAS, a map of the aub~ect property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be
and hereby is rezoned to P (P1 ned Development with medium to high density
residential, 10-20 dwelling u is per gross acre intent) Zone; subject to
conditions listed in attache Exhibit "C"; and that Exhibit "B" attached
hereto is made part of the ster Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect end be in force thirty (30)
days after its passage.

CONDITIONS
1-14. Standard Conditioos to the extent that they do not conflict with the
special conditions enumerated herein. In the .event. a conflict does
exist, the special conditions enumerated herein shall apply.
15. That the approval is based upon Exhibits A of Application 31-Z-80 and
A-2nd Revision, B-2nd Revision of Application 17-U-80 as may be amended
by additional conditions contained herein.
16. The applicant shall file a subdivision map to erase the property line
between the two existing parcels of the subject property and establish
the air apace division of the proposed condominium units.
17. The approval. is for a maximum of 67 dwelling unite on the overall 2.9{'
acre parcel.
