• AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY PREZONINC APPROXIMATELY .7 ACRE
FROM SANTA CLARA COUNTY R1-6 AND SANTA CLARA COUNTY R1-8
ZONE TO CITY OF CUPERTINO R1-7.5 ZONE; CONSISTS OF SEV-
ERAL UNINCORPORATED PARCELS LOCATED IN TiIE NORTHWEST
QUADRANT OF MCCLELLAN ROAD AND ORANGE AVENUE
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on July 3, 1980 an application was filed by City of Cuper-
tino (Orange Avenue/McClellan Road) (Application 41-Z-80) for ,the prezaning
of property from Santa Clara County R1-6 (One family residence, 6,000 aq.
ft. minimum lot size) and Santa Clara County R1-B (One family residence, 8,000
sq. ft. minimum lot size) zone Co City of Cupertino R1-7.5 (Residential, Single-
family, 7,500 sq. ft. minimum lot size) zone; and
WHEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Prezoning be granted; and
WHEREAS, the property to be prezoned is presently in Santa Clara County
R1=6 (One family residence, 6,000 sq. ft. minimum lot size) zone and Santa.
Clara County R1-8 (One family residence, 8,000 sq, ft. minimum lot size) zone;
and
WHEREAS, a map of the subject property is attached hereto as Exhibit.
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be
and hereby is prezoned to City of Cupertino R1-1.5 (Residential, Single-
family, 7,500 aq. ft. minimum lot size); and that Exhibit "B" attached hereto
is made part of the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of Cuper-
tino this Znd day of September 1980 and ENACTED at a regular meeting
of the City Council of the City of Cupertino this 15th day of September,
1980 by the following vote:

Written Description of Property to be Prezoned:
All that certain real propeity situate in the County of Santa Clara, State
of California, more particularly described as follows:
All of Lots 163, 164, 165, 16b and 167, as said lots are.ahovn upon that
certain map entitled "Map of Subdivision A. Nonta Vista", which map was filed
for record in the Office of the Recorder of the County of Santa Clara, State
of California, on April ll, 1917 is Volume P of Maps, at page 20;
Beginning at a point on the southwest corner of Lot 167 and the northerly
sideline of McClellan Road as shown on said map, said point being along that
certain annexation to the City of Cupertino by Resolution No. 4420 entitled
"HOWELL 76-9";
Thence North 109.21 feet alotlg the weater~~boundary of said Lot 167, said
line being along the said annexation "HOWELL 76-9" to the northwest corner
of said Lot 167;
Thence East 75.11 along the tortherly boundary of said Lot 167, said line
being along said annexation :'HOWELL 76-9". to a point being the southwest
corner of said Lot 163;
Thence North 109.21 feet along We westerly boundary of said Lot 163, said.
line being along said annexation "HOWELL 76-9", to a point being the northwest
corner of said Lot 163 and the intersection of that certain annexation to'
the City of Cupertino by Resolution No. 4211 entitled "FUCHS 76-4";
Thence East 140.15 feet along the northerly boundary of said Lot 163 and
it's easterly prolongation, said line being along said annexation "FUCHS
76-4", to a point an the easterly sideline of Orange Avenue and the intersection
of that certain annexation to the C~ty of~Cupertino by Ordinance No. 83
entitled "MCCLELLAN 1-A";
Thence South 218.42 feet along tha easterly dideline of Orange Avenue, said
line being along said annexation "lICCLELLAN 1-A", to a point of intersection
with said annexation "HOWELL 76-9";
Thence Weat 215.27 along the southerly boundary of Lots 164, 165, 166 and
167 and its easterly prolongation, said line being along said annexation
"HOWELL 76-9" to the point of beginning.
Containing 0.89 Acres, more or less.
