THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on July 3, 1980, an application was filed by City of Cuper-
tino (Stevens Creek Boulevard/Monta Vista) (Application 40-Z-80) for the rezoning and
prezoning of property from Santa Clara County CN (Neighborhood Commercial),
ML (Light Industrial), City of Cupertino P (Planned Development with coum~er-
cial and office intent), City of Cupertino CC (General Commercial), City of
Cupertino ML (Light Industrial), Santa Clara County R1-8 {One family resi-
dence, 8,000 aq. ft. minimum lot size), R3-2.4 (Low density multiple dwellings,
to unit per net acre), R3-4 (low density multiple dwellings) and City of Cuper-
tino R1-7.5 (Residential. Single-family, 7,500 sq. ft. minimum lot size) to
City of Cupertino P (Planned Development with Commercial and Incidental In-
dustrial and/or Residential intent), City of Cupertino P (Planned Develop-
ment with residential 4.4-12 dwelling units per gross acre intent) and City
of Cupertino R1-6 (Resldential, Single-family, 6,000 sq. ft. minimum lot size};
and
WHEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Prezoning and Rezoning be
granted; and
WHEREAS, the property to be prezoned and rezoned is presently in Santa Clara
County CN (Neighborhood Commercial), ML (Light Industrial), City of Cupertino
P (Planned Development with commercial and office intent), City of Cupertino
CG (General Commercial), City of Cupertino ML (Light Industrial), Santa Clara
County R1-8 (One family residence, 8,000 sq. ft. minimum lot size), R3-2.4
(Low density multiple dwellings, 16 unit per net acre), R3-4 (low density
multiple dwellings) and City of Cupertino R1-7.5 (Residential, Single-family,
7,500 sq. f[, minimum lot size) zones; and

WHEREAS, a map of the aub~ect property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A'' be and
hereby is prezoned and rezoned to City of Cupertino P (Planned Development
with Commercial and Incidental Industrial and/or Residential intent), City of
Cupertino P (Planned Development with residential 4.4-12 dwelling unite per
gross acre intent) and City of Cupertino R1-6 (Residential, Single-family.
6,000 aq. ft. minimum lot size) zones; subject to conditions listed in
attached Exhibit "C"; and that Exhibit "B" attached hereto la made part of
the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.

tino this 2nd day of September 1980 and ENACTED at a regular meeting
of the City Council of the City of Cupertino this 15th day of September,•1980

CONDITIONS OF APPROVAL FOR AREAS A AND B OF APPLICATION 40-Z-80
1-14. Standard Conditions to extent that they do not conflict with the special
conditions enumerated herein. In the event a conflict does exist, the
special conditions as enumerated herein shall apply.
15. The approval is based upon the zoning descriptions contained within
the legend of Exhibit A of Application 40-Z-80 as may be amended by
additional conditions contained herein.
16. The land use types, land use intensity and the circulation planning
within Areas A and B shall reflect the adopted Specific Plan for Old
Monts Vista labeled "Stevens Creek Boulevard Plan Line Action Plan".
The guidelines contained within the specific plan including the recorded
plan line for Stevens Creek Boulevard and its intersections with aide
streets shall be utilized to guide subsequent use permit and tentative
map proposals submitted within the zoning boundary for Areas A and B.
11. The conditions of approval for zoning Applications 1-Z-79, 21-Z-79.
27-Z-79 and 5-Z-80 and use permit Applications 31-U-79 and 1-U-80
shall remain in force unless there is a conflict with conditions
outlined in this document and/or the Old Monts Vista General Plan as
amended. In the manner of a conflict, the conditions contained herein
shall take precedence.
