AIJ ORDINANCE OF TiIE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY PREZONING APPROXIMATELY .22 ACRE
FROM SANTA CLARA COUNTY R1-8 ZONE TO CITY OF CUPERTINO P
ZONE; LOCATED ON THE SOUTii SIDE OF STtiVENS CREEK BOULE-
VARD APPROXIMATELY 200 FT. EASTERLY OF BYRNE AVENUE
THE CITY COUNCIL OF TtiE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WIiEREAS, on June 6, 1980, an application was filed by Byrne Avenue
Properties (Application 30-Z-80) for the prezoning of property from Santa
Clara County R1-8 (one family residence, 8,000 sq. ft. minimum lot size)
zone to City of Cupertino P (Planned Development with residential intent)
zone; and
WHEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that the Prezoning be granted; and
WfIEREAS, the property to be prezoned is presently in an R1-8 (one family
residence, 8,000 sq. ft. minimum lot size) zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit
"B"'as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE. BE IT ORDAINEll AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be and
Hereby is prezoned to a P (Planned Development with residential intent) zone,
subject to conditions listed in atr ~:hed Exhibit "C"; and that Exhibit "B"
attached hereto is made part of the Master Zoning Map of the City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.

1. That any future development proposal (Use Permit)-shall be consistent
