AN ORDINANCE OF THE CITY OF CUPERTINO ADDING
SECTION 2.04.040 TO THE CUPERTINO MUNICIPAL
CODE ESTABLISHING A PROCEDURE POR FILLING
CITY COUNCIL VACANCIES
THE CITY COUNCIL OF THE CITY OF CUPERTINO, STATE OF CALIFORNIA DOES ORDAIN
AS FOLLOWS:
Section 1. Addition
There is hereby added to the Cupertino Municipal Code the following
section:
2.04.040 - Vacancv - City Council. If any vacancy on the City Council
occurs other than by expiration of a term, the City Council shall, at its
option, within thirty days from the commencement of the vacancy, either fill
said vacancy by appointment for the unexpired term of the former incumbent
or call a special election to fill the vacancy. Such special election shall
be held within the time provisions of Section 36512 of the California Govern-
ment Code.
Notwithstanding any other provision of this section or of Section 36512
of the California Government Code, the City Council may also appoint any
person, otherwise qualified, to fill a City Council vacancy to hold office
only until the date of the next special election called under the provisions
of Sections 36512 and 36512.2 of the California Government Code.
INTRODUCED at a regular meeting of the City Council of the City of
Cupertino, this 7th day of Julx 1980, and ENACTED this 21st
day of July 1980, at a regulat meeting of the City Council of
Cupertino by the following vote:
