AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY PREZONING APPROBIMATELY 27.8 ACRES
FROM SANTA CLARA COUNTY R1-10 ZONE PLUS .4'} ACRES FROM
SANTA CLARA COUNTY R2 TO CITY OF CUPERTINO R1-10 ZONE;
AND .3± ACRES FROM SANTA CLARA COUNTY CN TO CITY OF CUP-
ERTINO CG ZONE; GENERALLY LOCATED IN THE SOUTHWE5T QUAD-
RANT OF STEVENS CREEK BOULEVARD AND FOOTHILL BOULEVARD
AND NORTHERLY OF STEVENS CREEK BOULEVARD BETWEEN CAL-
IFORNIA OAK WAY AND FOOTHILL BOULEVARD
THE CITY COUNCIL OF THE CITY OF CUPERTINO DOES ORDAIN AS FOLLOWS:
WHEREAS, on April 2, 1980, an application was filed by the City of
Cupertino (Hunter Hill/Carolyn Gardens Subdivision) (Application 15-Z-80)
for the prezoning of property from Santa Clara County R1-10 (one family
residence, 10,000 aq. ft. minimum lot size) zone, Santa Clara County R2
(two family residence -duplex) to City of Cupertino RL-10 (Residential,
Single-family, 10,000 sq. ft. minimum lot size) zone; and from Santa Clara
County CN (Neighborhood Commercial) to City of Cupertino CG (General Commer-
cial); and
WHEREAS, upon due notice and after one public hearing the Planning Com-
oission recommended to the City Council Chat the Prezoning be granted; and
WHEREAS, the property to be prezoned is presently in a Santa Clara
County R1-IO (one family residence, 10,000 sq. ft. minimum lot size) zone
(27.8 acres); a Santa Clara County R2 (two family residence -duplex) zone
(.4± acre) and a Santa Clara County CG (Neighborhood Commercial) zone (.3±
acre); and
WHEREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDALtiiED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be and
hereby is prezoned to City of Cupertino R1-10 (Residential, Single-family,
10,000 sq. ft. minimum lot size) zone (27.8 acres plus .4± acre) and City
of Cupertino CG (General Commercial) zone (.3± acre); and that Exhibit "B"
attached hereto is made part of the Master Zoning Map of ti:e City of Cuper-
tino.
Section 2. This ordinance shall take effect and be is force thirty (30)
days after its passage.
