ORDINANCE N0. 1014
AN ORDINANCE OF THE CITY OF CUPERTINO AMENDING SECTION 1
OF ORDINANCE N0. 2 BY REZONING APPROXIMATELY 5.3 GROSS
ACRES FROM R1-10 ZONE TOP ZONE; LOCATED ON THE NORTH
SIDE OP STEVENS CREEK BOULEVARD APPROXIMATELY 100 FT.
EASTERLY OF PHAR LAP DRIVE
WHEREAS, on February 11, 1980, an application was filed by Woolworth
Construction Company (Application 24-Z-19) for the rezoning of property from
R1-10 (Residential, Single-family, 10,000 eq. ft. minimum lot size) zone to
P (Planned Development with Residential Single-family intent) zone; and
WfiEREAS, upon due notice and after one public hearing the Planning Com-
mission recommended to the City Council that Rezoning be granted; and
WHEREAS, the property to be rezoned is presently in an R1-10 (Residential,
Single-family, 10,000 sq. ft. minimum lot size) zone; and
WHEREAS, a map of the subject property is attached hereto as Exhibit
"B" as a proposed amendment to the Master Zoning Map of the City of Cupertino.
NOW, THEREFORE, BE IT ORDAINED AS FOLLOWS:
Section 1. That the property described in attached Exhibit "A" be and
Hereby is rezoned to a P (Planned Development with Residential Single-family
intent) zone; subject to the conditions listed in attached Exhibit "~"; and
that Exhibit "B" attached hereto is made part of the Master Zoning Map of the
City of Cupertino.
Section 2. This ordinance shall take effect and be in force thirty (30)
days after its passage.
INTRODUCED at a regular meeting of the City Council of the City of Cuper-
tino this 16th day of June 1980, and ENACTED at a regular meeting of the City
Council of the City of Cupertino this Tth day of Jul. 1980 by the following

CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions enumerated herein shall apply.
15. The approval is based upon the general design guidelines and street
circulation pattern denoted on Exhibit A 2nd Revision of Application
24-Z-79, as may be amended by additional conditions contained herein.
16. Dwe111ngs constructed on lots abutting Tract 3628 (Oakdell Ranch) shall
be designed in a manner to minimize privacy intrusion into opposing
yard spaces. Upper story windows shall not be oriented to the opposing
rear yards of lots located in Tract 3628.
17. Whenever feasible, dwellings shall be oriented on lots in a manner to
maximize sun exposure on south-facing walls and at least one roof element
shall be oriented to accommodate solar collectors. The intent of this
condition is not to require passive solar design 1n terms of building
orientation nor require installation of active solar heating systems.
The intent is to provide an opportunity for subsequent owners to use
an active or passive solar system. The determination of feasibility
for dwelling orientation is based upon constraint related to tree loca-
tions, topography, and lot configuration.
