Ordinance 1010• ORDINANCE N0. 1010 AN ORDINANCE OF T11E CITY OF CUPEATINO REGI~INC TRAFFIC IN TtiE DOWNTOWN AREA NOTIFYING THE PUBLIC AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL DOES ORDAIN AS FOLLOWS: Section 1. Title 11 of the Cupertino Municipal Code is hereby amended by adding thereto a new chapter entitled "Regulation of Traffic in the Downtown Area", to be numbered Chapter 11.30, and to read as follows: 11.30.010 Definitions. For the purpose of this chapter, the following definitions apply: • A_ "Downtown area" means Stevens Creek Boulevard bounded by Tantau Avenue to the east and Peninsula Avenue/Bubb Road to the west; Wolfe Road bounded by Calls De Barcelona to the south and Homestead Road to the north; and De Anza Boulevard bounded by Bollinger Road to the south and Homestead P.oad to the Borth. B. "Cruising"means driving a motor vehicle on a highway (1) for the sake of driving, without immediate destination, or (2) with the purposes of (a) sightseeing repeatedly in the same area, and (b) socializing with other motorists or pedestrians. Driving emorgency vehicles on patrol, taxicabs for hire, and other business vehicles used for business purposes is not cruising. C. "Highway" and "motor vehicle" are defined in Sections 360 and 415, respectively, of the Vehicle Code. 11.30.020 Unlawful. Cruising is prohibited in the downtown area. 11 30 030 Violation - Penalty. Any person who violates any of the provisions of this Chapter shall be guilty of an s a infraction and upon conviction thereof shall be punished as s provided in Chapter 1.12. Section 2. This ordinance is hereby declarr.i an urgency measure and shall be in full force and effect immediately upon its adoption. The facts constituting such urgency are as follows: The City Council believes that cruising in the downtown area creates a hazard to the public health, peace, safety, comfort, and general welfare of the City of Cupertino and the residents therein in that traffic is seriously and substantially congested in the downtown area when cruising occurs. Said congestion causes economic hardship to some merchants in the downtown area, threatens the efficient operation of emergency services to residents of the City of Cupertino, and requires the expenditure of substantial sums of money for law enforcement supervision.
