Ati ORDINANCE OF THE CITY OF CUPERTINO ADDING
CHAPTER 10.49 TO THE CUPERTINO l9UliICIPAL COllE
TO BE ENTITLED "CONSUMPTION OF OR POSSESSION
OF OPEN COliTAItiER OF INTOXICATING LIQUORS IIi
PUBLIC PLACES".
THE CITY COUNCIL DOES ORDAIti AS FOLLOWS:
Section 1. Title 10 of the Cupertino l9unicipal Code is
hereby amended by adding thereto a new chapter entitled
"Consumption of or Possession of Open Container of
Intoxicating Liquors in Public Places", to be numbered
Chapter 10.49, and to read as follows:
"10.49.010-Unlawful
It shall be unlawful for any person to drink or
possess an open container of any intoxicating
liquor upon any public street, lane, alley,
parkway, public park or parking lot in the
City, except as may be authorized by resolution
of the City Council. This section shall not
be construed to prohibit the transpartation
of open containers of any intoxicating
liquor from one location to another in a legal
manner as prescribed by state law..
10.49.020-Violation - Penalty
Any person who violates any of the provisions
of this chapter shall be quilty of an infraction
and upon conviction thereof shall be punished
as provided in Chapter 1.12."

Section 2. This ordinance is hereby declared an urgency
measure and shall be in full force and effect immediately
upon its adoption. The facts constituting such urgency are
as follows:
The City Council believes that the consumption or possession
of open containers of intoxicating liquor in public places
creates a hazard to the public health, peace, safety, comfort,
and general welfare of the City of Cupertino and the residents
therein.
INTRODUCED AND ENACTED at a regular meeting of the City
Council of the City of Cupertino this 30th day of April, 1980,
by the following vote:
