AN ORDINANCE OF THE CITY OFD' CUPERTINO AMENDING ORDINANCE N0, 002 BY
ADDING THE CLASSIFICATION "PLANNED COMMUNITY DISTRICT" (PC-H).
THE CITY COUNCIL OF THE CITY OF C~JPERTINO DOES ORDAxIJ AS FOLLOWS:
SECTION 1: Amendment
Section I:l: Ordinance No. 002 is hereby amended by the addition
of the zoning classification entitle3 "Planned Community District" (PC-H).
SECTION 2: Establishment
Section 2:1: "PC-H" Districts ma.y be established on parcels of
land which are suitable for and of sufficient acreage to contain a
planned community for which development plans have been submitted and
approved. The minimum area of a planned community shall be not less
than twenty-five (25) acres.
SEC'~ION 3: Application to Establish "PC-H" District
Section 3:1: Application for the establishment of a "PC-H" Dis-
trict shall include an application fora master use permit for all de-
velopments within the district, which use permit or any other use per-
mit as required in Section ~ of this ordinance must be approved prior
to establishment of the district. Such application fora use permit
shall include the following:
a. A map showing:
(1) Topography of the land, contour intervals as
required 'py the planning commission.
(2) Proposed street system and lot design.
(3) Areas proposed to be dedicated or reserved
for parks, parkways, playgrounds, school
sites, public or quasi-public buildings and
other such uses.
(4) Areas proposed for commercial uses; off-
street parking, multiple and single family
dwellings and all other uses proposed to
'pe established within the district.
(5) Proposed location of buildings on the land.
b. Gene ral perspective drawings of all proposed build-
ings and structures other than single family resi-
deuces.
c. Other data and information which may be deemed neces-'
sary by the planning commission for proper considers-
tion of the application.

SECTION 6: Variation of Re~;ulat.ons
Sectio~z G: 1: The regulations speeifie~? tin this ordinance may be
varied when such variance will resul'~ in s.mproved design of the devel-
opment, and will permit desira'ale arrangement of structures in relation
to narking areas, parks and parkways, pedestrian walks and other such
features, provided that the overall ~~.verae density should not exceed
sixteen (15) living units per acre b~~.sed on Sross acreage desi nated
for residential usage under the requirements of Section 3:1 (a~ (4) of
this ordinance.
SECTION 7: Approval of City Council
Section 7:1: All use permits, ~~xceptions and variances granted
under this ordinance shall be reviewod and approved by the City; Council
prior to the enactment of ordinance ~rant~.ng the PC-H zoning.
SECTION ~: Architectural and Site A ~,~roval
Section 8:1: All site la~Touts and landscaping are subject to the
provisions of Ordinance r1o. 002(f) of the city.
SECTION 9: Severabilit;;~ Clause
Section g: 1: If anyT section, subsection, se:~~tence, clause or
phrase of this ordinance is for any reason held to be unconstitutional,
such dec_slon shall not effect the validity of the remaining portions
of this ordinance. The legislative body herc'Qy declares that it would
have enacted this ordinance and eacY~ section, subsection, sentence,
clause or phrase thereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared
unconstitutional.
SECTION 10: Publishing, Clause
Section 10:1: The City C~.erlc ~.s hereby authorized and directed to
cause a certified cohy of this ordinance to be pualished at least once
within fifteen (15) days after its Enactment in the Cupertino Courier,
the official newspaper of the City; publi~~hed and circulated within
the City of Cupe rtino.
