BACKGRQUND AND DISCUSSIUN
The Santa Clara County Sheri~s Department has requested that stop signs be installed at Garden
Gat~ Drive/Glencoe Drive, Beardon Avenue/Hanford Drive, and Beardon Avenue/Fargo Drive.
T'hese three intersections are each uncontrolled four-legged ix~tersections.
Section 21800 of the California Vehicle Code (CVC) outlines the righfi-of-way rules pertaining
to uncontrolled interseckions which, if followed by all motorists, would ensure the safety of all
motorists travelling through these intersections. However, in reality, conflicts often arise
because one of the sireets at each intersection generally serves as the primary street
Consequently, a motorist on that street may erroneously believe that he or she has the right-of-
way, and consequentiy not yield, regarclless of whether that motorist approached the intersection
before a motorist on the intersecting minvr street. At Garden Gate/Glencoe, Garden Gate serves
as the primary street; at the other two locations, Beardon serves as the primary street.
T'he intersection of Garden Gate/Glencoe has had two reported accidents within the previous
three years caused by right-of-way violation. Beardon/Han£ord and Beardon/Fargo have had no
reported accidents caused by right-of-way violation; however, observations by the SherifPs
Department and City staff indicate that the potential for conflict exists at these intersections. At
each of ~these three iocations the installation of a stop sign on the minor street approaches
{Glencoe, Hanford and Fargo) would enhance safety by clearly assigning the right-of way to the
primary street.
None of the three intersections would meet warrants as established by the State of California for
an a11-way stop, nor would an all-way stop be an appropriate measure. The warrants for a two-
way stop, however, simply allow for engineeri.ng judgment to determine the need foi a stop sign

a# locations where the normal right-of-way rules would not necessarily be expected to result in
safe vehicular operation. A two-way stop {stopping the minor street approaches) is therefore
appropriate for these three intersections.
Authority is granted to local jurisdictions to place stop signs through Section 22450(b) of the
CVC, which states, "Notwithstanding any other provision of law, a local authority may adopt
rules and regulations by ordinance or resolution providing for the placement of a stop sign at any
location on a highway under its jurisdiction where a stop sign would enhance traffc safety."
