CC Resolution No. 99-010RESOLUTION NO. 99- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO EXTENDING AN EXISTING STORM DRAINAGE SERVICE FEE TO THE PROPERTIES IN THE RANCHO R1NCONADA AREA WHEREAS, the City Council held a public heating on November 2, 1998, to receive protests from the property owners of the Rancho Rinconada area (as shown on Attachment A) regarding a proposal to extend the currently-existing storm drainage service fee to the real property of the Rancho Rinconada area, in the event that property is annexed to the City; and WHEREAS, a majority of property owners did not protest the extension of the fee; and WHEREAS, pursuant to City of Cupertino Resolution No. 98-204 and the California Constitution, Section 6, Article XIIID, the City conducted a ballot by mail to allow the property owners of the Rancho Rinconada to vote on the extension of the fee; and WHEREAS, the City Clerk tabulated the ballots, of which 642 ballots were in favor and 209 ballots were opposed to the extension of the fee; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino, that Ordinance No. 1599is hereby extended to the Rancho Rinconada area properties in the event of annexation to the City of Cupertino.
