Staff Presentation: Peter Gilli, Senior Planner, explained that the neighborhood is
currently going through the process of updating their regulations and there is an
interim ordinance in place. The interim ordinance requires design review of any
addition. Mr. Gilli gave a brief description of the project and stated that the applicant
proposes to build the structure as close to the rear property line as possible. The garage
conforms to the height and setback requirements of the accessory structure ordinance.
The Municipal Code allows living space to be attached to the garage and the applicant
is not proposing a second living unit at this time. However, in the future, this unit
would meet the requirements of a second living unit if the garage were to be converted.
Staff recommends approval with the minor change that the interior of the garage be
adjusted from 19x20 to 20x20 clear interior space. The applicant is aware of this
condition and has agreed to make that modification.
Gilbert Wong, Commissioner, asked if one foot would make a difference in the interior
space. Mr. Gilli stated that the parking ordinance requires 2 10x20 parking spaces. Mr.
Wong also asked if the driveway was wide enough to accommodate 2 cars. Mr. Gilli
stated that the driveway is narrow, but it widens just past the building and two cars can
park side by side in the driveway.

Director's Approval to construct an 864 square foot addition to an existing 1,232
square foot residence and construct a new one-car, detached garage that does not
meet the accessory structure setbacks in a Planned Development Zoning District.
Design Review Committee decision final unless appealed
Staff Presentation: Colin Jung, Senior Planner, explained that the project was located in
a planned development zone that was originally built in a county pocket that is now
annexed to the city (Monta Vista). The current location of the carport does not meet the
accessory structure setbacks. The new detached garage is proposed to be built at the

rear of the property. The detached garage would have a 1-foot side and rear setback
instead of the 4.5-foot setback for a building at the proposed height. Staff supports a
one-car garage with the lesser accessory structure setbacks because the applicant is
proposing to use materials that requires very little maintenance and will be keeping the
drainage from the roof on the property. This is also consistent with the existing
neighborhood. The neighbors that would be affected from the east and the north have
written letters in support of the accessory structure. Staff recommends approval.
Taghi Saadati, Chairman, was concerned about the closeness of the garage to the
property line in regards to fire codes. Mr. Saadati stated that having the garage at the
rear of the property really improves the look of the home.
John Barton, Architect, explained that according to the fire code, when there is a wall
close to the property line any thing that is within 3 feet of the property line in a
residential zone must be a one-hour firewall. The applicant will be talking to the
neighbors about whether or not to put up a fence in that one-foot setback area.
Mr. Saadati asked whether the applicant had considered a two-foot setback. He was
concerned that allowing a one-foot setback could set a precedent. Mr. Jung stated that
most of the projects that would fall into this type of situation are located in the Manta
Vista neighborhood.
Mr. Saadati suggested adding condition stating the removal of the fence may be
necessary for future maintenance and access for the garage. Mr. Barton stated that the
building could be built to have a 2-foot side and rear setback. The committee agreed
that there should be a 2-foot separation between the fence and all the way around the
garage structure for access.
