RECOMMENDATION:
a) Continue U-2007-11 to January 7, 2008 per the applicant's request (Exhibit A).
b) Schedule the applicant's appeal of M-2007-02 for January 7, 2008
BACKGROUND
On November 13,2007 and December 11, 2007, the Planning Commission considered
the applicant's request. The Planning Commission recommended denial of the Use
Permit for Marukai (U-2007-11) and denied the request to modify the existing use
permit allowing food services along the'rear service corridor (M-2007-02) due to
neighborhood opposition.
The applicant is requesting that the City Council continue this item to its January 7,
2007 meeting so that both the Use Permit request for Marukai (U-2007-11) and the use
permit modification appeal (M-2007-02) may be discussed and considered at the same
time (Exhibit A). In addition, this provides additional time for the applicant to
potentially have another formal neighborhood meeting and to address all of the
neighbors' concerns.

APPLICATION SUMMARIES:

which food service businesses will be allowed in the Marketplace Shopping
Center along the rear service corridor.
RECOMMENDATION:
Staff recommends that the Planning Commission:
1. Recommend to the City Council to approve the use permit request to permit a
food store (Marukai) with the staffsuggested conditions.
2. Approve the modification to the use permit 16-U-76 to permit certain food
service businesses along the rear corridor of the shopping center.
*The Planning Commission's decision is final on the use permit modification request
regarding food services.
ENVIRONMENT At ASSESSMENT: Categorically Exempt
BACKGROUND:
On November 13, 2007, the Planning Commission considered the above requests. The
Planning Commission expressed concerns on Marukai's proposed cooking activities
and changing the original language of the condition #4 regarding limitations on food
services. The Planning Commission directed the applicant to continue to work with the
neighbors to reach consensus on resolutions to some of the neighborhood concerns.

DISCUSSION:
Use Permit
The applicant/property owner did not hold another formal neighborhood meeting but
has advised staff that they are attempting to communicate individually with the
neighbors regarding concerns expressed at the November 13, 2007 Commission hearing.
The results of any offline discussions will be presented by the applicant to the
Commission at the public hearing. Staff has not received any additional
correspondence from neighbors regarding the proposed food market since the last
Commission hearing.
One key change that has happened since the last meeting is that Marukai has eliminated
the proposed kitchen from their plans in response to the neighborhood and
Commission concerns regarding the potential off-site impacts associated with food
cooking activities. As a result, there will not be any cooking of hot foods at the site. The
market will only be stocking general pre-packaged food products, general consumer
goods and general grocery goods (including but not limited to fresh fruits, vegetables,
fish, meat and dairy products). The small bakery that is proposed will only sell pre-
made bakery goods that are shipped to the store from off-site locations.
Staff recommends that the Planning Commission approve the Use Permit request with
the conditions outlined in the model resolution.
Condition to allow Food Services
The difficulty with the existing condition (condition #4, 16-U-76M) is that it eliminates
all business involving food preparation without defining what is considered "food .
preparation". The condition also makes no distinction between food uses with off-site
impacts from food uses witlllimited or no offsite impacts. In addition, the existing
condition does not clearly explain the intent. Staff believes that the intent of the
condition is to limit food services that may create cooking odor, vector and refuse
problems. Therefore food uses such as ice cream or yogurt stores (or any other similar
uses that may have incidental food cooked or prepared off-site) that do not have any
negative impacts to the adjacent neighbors should be permitted.
The proposed yogurt store (Yogurtland) has confirme,d that all of their yogurt products
are pre-mixed and shipped frozen from off-site locations. The only preparation work is
pouring the pre-mixed yogurt into a machine that turns the yogurt from liquid form
into soft-serve frozen yogurt. In addition there will be cutting and washing of fresh
fruits as toppings for the soft-serve frozen yogurt (please see exhibit A). As for
Marukai, the only food preparation work that is being requested is to cut and package
fresh fish and meat.

Staff believes that the existing condition #4 can be significantly simplified in a way to
allow some limited food uses whi.1e protecting the legitimate concerns of the
neighborhood. Staff proposes the following modifications:
Condition #4 - Use Limitation (Rear Corrido7'):
The existing restaurant and specialty food services involving on-site food preparation
which are located adjacent to the gated portion of the rear corridor may remain;
however, new food services involving on-site food preparation shall not be permitted in
this area. Food preparation is defined as on-site cooking or warming of food
products by the application of h~'at.
The intent of this condition is to prohibit new food services adjoining the rear corridor
that will create or attract food odor, vector and refuse nuisances. not only to pre.Tcnt

Additional Conditions
Staff's objective is to also tighten the conditions on the shopping center to allow greater
assurances to the neighbors that all off-site impacts are minimized or eliminated; the
following new conditions are recommended to be added to the use permit:
Refuse and Recycling Control
Self containing refuse and recycling compactors and/ or enclosures shall be provided in
all new food establishments located along the rear corridor. All refuse shall be double
bagged (or placed in containers) and be sealed to prevent leakage. No refuse (including
food products) or recycling products shall be stored or placed in a manor that would be
cause odor and/ or vectors problems. In the event that there is evidence that there are
problems with vectors and/or, the Planning Commission may hold a public hearing to
review or revoke the use permit.
Vector Control
The shopping center shall maintain a contract with a licensed vector control specialist to
perform vector control and prevention services to the shopping center on a monthly
basis. In the event that there is evidence that there are problems with vectors at the
shopping center, the Planning Commission may hold a public hearing to review or

Rear Corridor Limitations
The gated rear corridor area shall be maintained and be used as an emergency fire
access and incidental shopping center building maintenance/ operational access only.
There shall not be any other activities along the rear corridor (including but not limited
to storage of any kind and loading activities). There shall not be any employee
congregation or break activities in the gated rear corridor in order to prevent
disturbances to the adjacent residential properties.
Early Morning Refuse and Recycling: Pickup
All refuse and recycling pickup shall not occur prior to 8 AM on any days of the week.

The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, ahd other exactions. Pursuant

How the machine works....
With soft serve, this is accomplished by a
special machine at the point of sale.:. Pre-mixed
product is introduced to the storage chamber of
the machine where it is kept at +3C. When
product is drawn from the draw valve, fresh mix
i~ introduced to the freezing chamber either by
gravity or pump. It i$, then churned and quick
frozen and stored until required.

APPLICATION SUMMARIES:
Modification to an existing Use Permit (16-U-76) to modify the condition under which
food service businesses will be allowed in the Marketplace Shopping Center along the
rear service corridor.
Use Permit approval to allow a food store (Marukai) totaling 28,690 square feet located
in the Marketplace Shopping Center (foJ;'mer Longs Drug site).
RECOMMENDATION:
Staff recommends that the Planning Commission:
1. Recommend to the City Council to approve the modification to the use permit
16-U-76 to permit certain food service businesses along the rear corridor of the
shopping center.
2. Recommend approval of use permit request to permit a food store (Marukai)
with the staff suggested conditions.
ENVIRONMENTAL ASSESSMENT: Categorically Exempt
BACKGROUND:
Back in 1976, a use permit (16-U-76) was approved by the Planning Commission that
consisted of conditions on the Marketplace Shopping Center to limit the size, location,
type and review process for food service businesses. The use permit had guidelines
that limit food services that are located adjacent to the gated portion of the rear service
corridor. In addition, it also requires large food stores (exceeding 10,000 square feet) to
obtain a use permit from the City.
The owner of the shopping center is requesting modifications to the use permit in order
to allow for new food service businesses along the gated portion of the service corridor,
such as frozen yogurt shops or ice cream stores, and to allow the Marukai grocery store
to have limited food preparation activities associated with their operation. Also as part
of this application, the property owner is requesting a use permit to allow Marukai
grocery store to operate at the (former Longs Drugs site).

DISCUSSION:
Condition to allow Food Services
According to condition #4 of use permit 16-U-76,

"The existing restaurant and specialty food services involving on-site food preparation which are
located adjacent to the gated portion of the rear corridor may remain; however, new food services
im.Jolving on-site food preparation shall not be permitted in this area. TIre intent of this
condition is not only to prevent an increase in the number of above described food establishments
adjoining the rear corridor, but also, upon termination of occupancy, to preclude replacement of
existing.establishments with food services which require a neuJ use permit..."
The intent of this condition is to minimize the impacts (cooking and refuse odor) from
restaurants and specialty food services to the adjacent residential neighborhood to the
south. The condition continues by saying,
"For example, an existing sit-down restaurant could be replaced by anot/rer sit-down restaurant
(provided the new restaurant was no larger than the existing one and had similar operating
characteristics), but an existing site down restaurant could not be replaced by a specialty food
store."
The City Code defines restaurants and specialty food uses. However" on-site food
preparation" is not defined in the City Code. If interpreted literally, any activities or
uses that involve preparation of any ingredients or products for consumption (for onsite
or offsite; by people or animals) would be included in this condition regardless if the
use or business generates cooking or refuse odor. The applicant believes that the main
concern is the potential odor that heavy cooking activities may generate and the refuse
odor from these uses, so there ought to be flexibility in the use permit to allow some
food preparation that will not generate odor impacts, such as a yogurt/ ice cream store,
or any other similar businesses. In the example given in the condition, it is confusing as
to why it would be appropriate for an existing restaurant already located along the rear
corridor to be replaced by another similar restaurant but it would not be appropriate for
it to be replaced by a new specialty food use. Specialty food uses generally are less
intensive uses because of fewer cooking activities generate less or no cooking odor.
Also, condition #4 does not clarify what preparation work may be allowed in a grocery
store such as the proposed Marukai Market. The meat or fish market portion of the
Marukai may be considered as specialty food use. However, preparing, cutting and
packaging the uncooked meat and fish will not have any cooking odor associated with
that process and in staff's opinion should be allowed. In addition, Marukai like most
grocery stores will be offering pre-made food or lunch boxes to patrons for off-site
consumption. Food will be prepared and cooked in the kitchen area and then packaged
and placed on refrigerated displays. There will not be any seating or table
arrangements in the store to maintain the retail environment. Marukai has already
confirmed that odor filtration systems will be installed on all of the hoods. Staff

believes the preparation of foods such as cold sandwiches, sashimi, salads or fruit plates
should be allowed.
Staff recommends that Condition #4 be amended as follows:
The existing restaurant and specialty food services involving on-site cooking...feed
prcpuration which are located adjacent to the gated portion of the rear corridor may
remain; however, new food services involving on-site cooking food prcparation shall
not be permitted in this ::rrca unless the following conditions are met:
.:. Odor abatement systems shall be installed and maintained.
.:. Self containing refuse and recycling compactors and/ or enclosures shall be
provided.
.:. Cooking and food preparation areas shall be less than 10% of the total tenant
space.
.:. The exhaust from the cooking area must vent in the front half of the building
away from the residential neighborhood.
.:. Cooking must be incidental both,in terms of product and area of sales.
All other types of food service uses shall require a Use Permit from the Planning
Commission. The intent of this condition is not only to minimize the impacts of prcycnt

Marukai's Use Permit Request
According to the condition # 2 of use permit 16-U-76,
"Large food stores exceeding 10,000 sq. ft. shall require use permit review"
Marukai is proposing to locate a Japanese food market approximately 28,690 square feet
in size located at the former Longs Drug site. Part of the tenant space will be shared by
Daiso Japan (approximately 7,850 sq. ft.), which is a Japanese houseware retail store.
Marukai proposes to stock general pre-packaged food products, general consumer
goods, fresh fruits and vegetables and fresh fish and meat. Marukai will also be
offering pre-packaged lunch boxes for off-site consumption. In addition, a small bakery
is proposed near the front of the store where pre-made and pre-packaged bakery goods
will be sold.
Marukai and Daiso are the same type of general commercial uses similar to the prior
Longs Drug Store. Therefore the projected parking generation based on the City

Ordinance would not change. Consequently, no additional parking assessment is
necessary. The following is a summary of some facts of the new store:

Neighborhood Comments
A neighborhood meeting was held on November 2, 2007, at the project site. A
summary of the comments and questions expressed at the meeting are summarized
below:

store.
.:. Concerns with insufficient parking to facility the new stores.
.:. Concerns with odor from refuse and early hour garbage pickup activities. In

prior to securing a use permit approval from the City.
Staff has also received email correspondence from adjacent residential property owners
expressing concerns about the request to modify the existing use permit to allow food
service businesses.

Staff response:
Odor Abatement:
Odor abatement system will be installed as part of this project. In addition, staff
recommends that the ventilation piping be routed so the vents would be located
furthest away from the residential property to the south to the maximum extent
possible.
Fish Market:
According to Marukai, fresh fish will be delivered to the store on ice in styrophon
boxes. There will not be any live fish bought in and stored in fish tanks.
Parking:
See previous parking section of the report.
Refuse:
The City has a franchise agreement with the Los Altos Garbage company, which is
multi-year agreement that gives the garbage company flexibility to pick up refuse on
commercial properties between MondaY through Saturday with unspecified time frame
as long as the operation conforms to the City's Noise Ordinance. The only exception to
this is if the garbage route involves driving through the rear service corridor then the
first refuse pick shall not start earlier than 8 AM. All of the shopping center's refuse
facilities are located in the parking lot area away from the rear service corridor. Please
refer to the previous refuse section of the staff report for a detailed schedule pick up of
the shopping center.
Tenant Lease Agreement:
The City does not get involved in the tenant/landlord lease agreement process and
timing. The fact that a use permit is being requested indicates that the shopping center
and MarukaijDaiso understand that they will have to conform to all of the conditions
resulting from this approval process.

one or more public hearings on this matter; and
WHEREAS, the applicant has met the burden of proof required to support said

1) The proposed use, at the proposed location, will not be detrimental or injurious to

5. COOKING AND FOOD PREPARATION LIMITATION
Cooking and food preparation are shall be limited to no more than 10% of the
tenant space. In addition, cooking must be incidental both in terms of product

6. EXHAUST VENT LOCATION
The exhaust from the cooking area must vent in the front half of the building away
from the residential neighborhood.
7. CONSTRUCTION MANAGEMENT PLAN
A construction management plan shall be prepared by the applicant and approved
by staff prior to issuance of building permits. Staging of construction equipment
shall not occur within 250 feet of any residential property.
8. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER
EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,

This Resolution, as any others, is the law that the city government must obey.
Once again, the city officials totally ignored us, the residents who are effected by their controversial decisions.
Unfortunately, there is nothing new in such ignorance. We had too many examples in the very resent past
to learn that the City is more favorable to businesses and developers
than to people who elected the city officials and pay their salaries.
But this time the city went too far and created a real legal crisis.

Most of us, ithe residents living around the Market Place, would like to meet with you and other officials who

Dear Steve,
At our meeting on October 24, 2007, it became obvious to me that you are trying to find a way to
cover up and correct the mistake you made in granting a permit to the yogurt shop. You also are
trying to find a way to allow food preparation in the Marukai Store. Your mistake was that you
choose to ignore the mandates of Resolution 3055 but forgot that the residents are watching.
Now you want to amend the subject resolution to accommodate and correct your errors. First,
you want to meet with the City Attorney for clarification of Resolution 3055. Once you get the
answer you need to continue, you will put the process on the fast track through the Planning
Commission and City Council. And of course, you said that the residents will have the
opportunity to attend these hearings which is their legal right, yet when I asked that you explain
your agenda at a neighborhood meeting you did not want to attend.
As far as I am concerned the Resolution has been interpreted more than once. The words are
very clear and speak: for themselves. I suggest you read Peter Gillis' letter of December 27,2000
which further clarifies the restriction and obviously sets a precedent. It should stand as written
without further scrutiny. It is your responsibility as a city employee to enforce the restrictions of
Resolution 3055. This resolution has been in place since 1987 and has protected the residents
who back up to the Market Place effectively. The Resolution must not be amended to cover up
your error. Steve, take ownership of your mistake and move forward by doing the right thing.
To conclude, as Resolution 3055 was in full force and effect when both the yogurt shop and
Marukai. Market (food preparation) applied for permits, both must be declined. The Resolution
is in place and governs the alleyway!

MARUKAI CORPORATION U.S.A. was founded in 1965 by MARUKAI CORPORATION, INC.
( Head Quarter Osaka, Japan)
Based in Los Angeles and Hawaii. the business began as an importer for Japanese food,
house hold items. electronics, furniture, health foods, and health and fitness items.
In 1982, utilizing the benefits as a trading company, Marukai opened the first retail shop
"Membership Marukai Wholesale Mart" in Gardena, California.
Marukai established a unique purchasing logistics, strategy and inventory control which
made it possible to provide the customers with great value on Japanese items.
Since then, Marukai has been LA area's price leader.
In 1996, Marukai opened the" Marukai Forum" in Gardena, CA. The 45000sq:ft shop
offers Japanese food, household items, electronics. ceramics, health and beauty products,
Japanese furniture, Kimono and antiques, which offers one of the best selection
in the entire US.
Currently, there are 10 retail shops that includes membership, non-membership,
and the 98 cent PLUS stores.
Marukai will continue to satisfy the clients and their 80,000 + members.
