RESOLUTION NO. 07-163
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING
THE CITY MANAGER TO EXECUTE AMENDMENT NO.1 TO THE AGREEMENT
WITH THE COUNTY OF SANTA CLARA FOR THE JOINT UTILIZATION
AND MAINTENANCE OF FACILITIES RELATING TO THE COUNTY OF
SANTA CLARA TRAFFIC OPERATIONS SYSTEM
WHEREAS, the City Council authorized the City Manager to execute an Agreement with
the County of Santa Clara for the Joint Utilization and Maintenance of Facilities Relating to the
County of Santa Clara Traffic Operations System on May 5, 2003; and
WHEREAS, the Agreement allows the County to install conduit in City right-of-way and
utilize existing available City-owned conduit to accommodate fiber optic cable; and
WHEREAS, the Silicon Valley Intelligent Transportation Systems (SV-ITS) West
Corridor Project will provide for the installation of new conduit and fiber-optic cable along
Stevens Creek Boulevard; and
WHEREAS, the SV-ITS West Corridor Project is jointly participated by the County of
Santa Clara, CaItrans, and the Cities of San Jose, Santa Clara, Campbell, and Cupertino; and
WHEREAS, the County of Santa Clara and the City of Cupertino desire to amend the
Agreement to extend the limits of the joint utilization and maintenance of fiber-optic facilities to
incorporate conduit and fiber-optic cable installation included in the SV-ITS West Corridor
Project; and
NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorizes the City
Manager to execute Amendment No. 1 to the Agreement with the County of Santa Clara for the
Joint Utilization and Maintenance of Facilities Relating to the County of Santa Clara Traffic
Operation System.
PASSED AND ADOPTED at a special meeting of the City Council of the City of
Cupertino this 18th day of September 2007 by the following vote:
